Birth of Johnny Adair, Northern Irish Loyalist

Johnny Adair, leader of “C Company” of the Ulster Loyalist paramilitary organisation Ulster Freedom Fighters (UFF), a cover name of the Ulster Defence Association, is born in Belfast, Northern Ireland, on October 27, 1963. He is known as Mad Dog. He is expelled from the organisation in 2002 following a violent power struggle. Since 2003, he, his family and a number of supporters have been forced to leave Northern Ireland by other loyalists.

Adair is born into a working class loyalist background and raised in Belfast. He grows up in the Lower Oldpark area, a site of many sectarian clashes during “The Troubles.” By all accounts, he has little parental supervision, and does not attend school regularly. He takes to the streets, forming a skinhead street gang with a group of young loyalist friends, who “got involved initially in petty, then increasingly violent crime.” Eventually, he starts a rock band called Offensive Weapon, which during performances espouses support for the British National Front.

While still in his teens, Adair joins the Ulster Young Militants (UYM), and later the Ulster Defence Association, a loyalist paramilitary organisation which also calls itself the Ulster Freedom Fighters.

By the early 1990s, Adair has established himself as head of the UDA/UFF’s “C Company” based on the Shankill Road. When he is charged with terrorist offences in 1995, he admits that he had been a UDA commander for three years up to 1994. During this time, he and his colleagues are involved in multiple and random murders of Catholic civilians. At his trial in 1995, the prosecuting lawyer says he is dedicated to his cause against those whom he “regarded as militant republicans – among whom he had lumped almost the entire Roman Catholic population.” Royal Ulster Constabulary (RUC) detectives believe his unit killed up to 40 people during this period.

Adair once remarks to a Catholic journalist from the Republic of Ireland upon the discovery of her being Catholic, that normally Catholics travel in the boot of his car. According to a press report in 2003, he is handed details of republican suspects by British Army intelligence, and is even invited for dinner in the early 1990s. In his autobiography, he claims he was frequently passed information by sympathetic British Army members, while his own whereabouts were passed to republican paramilitaries by the RUC Special Branch, who, he claims, hated him.

The Provisional Irish Republican Army (IRA) bombing of a fish shop on the Shankill Road in October 1993 is an attempt to assassinate Adair and the rest of the UDA’s Belfast leadership in reprisal for attacks on Catholics. The IRA claims that the office above the shop is regularly used by the UDA for meetings and one is due to take place shortly after the bomb is set to explode. The bomb goes off early, killing one IRA man, Thomas Begley, and nine Protestant civilians. The UFF retaliates with a random attack on the Rising Sun bar in Greysteel, County Londonderry, which kills eight civilians, two of whom are Protestants. Adair survives 13 assassination attempts, most of which are carried out by the IRA and Irish National Liberation Army (INLA).

During this time, undercover officers from the Royal Ulster Constabulary record months of discussions with Adair, in which he boasts of his activities, producing enough evidence to charge him with directing terrorism. He is convicted and sentenced to 16 years in HM Prison Maze. In prison, according to some reports, he sells drugs such as cannabis, ecstasy tablets and amphetamines to other loyalist prisoners, earning him an income of £5000 a week.

In January 1998, Adair is one of five loyalist prisoners visited in the prison by British Secretary of State for Northern Ireland, Mo Mowlam. She persuades them to drop their objection to their political representatives continuing the talks that leads to the Good Friday Agreement in April. In 1999, he is released early as part of a general amnesty for political prisoners after the Agreement.

Following his release, much of Adair’s activities are bound up with violent internecine feuds within the UDA and between the UDA and other loyalist paramilitary groupings. The motivation for such violence is sometimes difficult to piece together. It involves a combination of political differences over the loyalist ceasefires, rivalry between loyalists over control of territory and competition over the proceeds of organised crime.

In 1999, shortly after his release from prison, Adair is shot at and grazed in the head by a bullet at a UB40 concert in Belfast. He blames the shooting on republicans, but it is thought that rival loyalists are to blame.

In August 2000, Adair is again mildly injured by a pipe bomb he is transporting in a car. He again attempts to blame the incident on an attack by republicans, but this claim is widely discounted. A feud breaks out at the time between the UDA and the Ulster Volunteer Force (UVF) leaving several loyalists dead. As a result of Adair’s involvement in the violence, the then Secretary of State for Northern Ireland, Peter Mandelson, revokes his early release and returns him to prison.

In May 2002, Adair is released from prison again. Once free, he is a key part of an effort to forge stronger ties between the UDA/UFF and the Loyalist Volunteer Force (LVF), a small breakaway faction of the UVF loyalist paramilitary organization in Northern Ireland. The most open declaration of this is a joint mural depicting Adair’s UDA “C company” and the LVF. Other elements in the UDA/UFF strongly resist these movements, which they see as an attempt by Adair to win external support in a bid to take over the leadership of the UDA. Some UDA members dislike his overt association with the drugs trade, with which the LVF are even more heavily involved. A loyalist feud begins, and ends with several men dead and scores evicted from their homes.

On September 25, 2002, Adair is expelled from the UDA/UFF along with close associate John White, and the organisation almost splits as Adair tries to woo influential leaders such as Andre Shoukri, who are initially sympathetic to him. There are attempts on Adair’s and White’s lives.

Adair returns to prison in January 2003, when his early release licence is revoked by Secretary of State for Northern Ireland, Paul Murphy, on grounds of engaging in unlawful activity. On February 1, 2003, UDA divisional leader John Gregg is shot dead along with another UDA member, Rab Carson, on returning from a Rangers F.C. match in Glasgow. The killing is widely blamed on Adair’s C Company as Gregg is one of those who organised his expulsion from the UDA. Five days later, on February 6, about twenty Adair supporters, including White, flee their homes for Scotland, widely seen as a response to severe intimidation.

Adair is released from prison again on January 10, 2005. He immediately leaves Northern Ireland and joins his family in Bolton, Lancashire, where it is claimed he stays with supporters of Combat 18 and the Racial Volunteer Force.

The police in Bolton question Adair’s wife, Gina, about her involvement in the drugs trade, and his son, nicknamed both “Mad Pup” and “Daft Dog,” is charged with selling crack cocaine and heroin. Adair is arrested and fined for assault and threatening behaviour in September 2005. He had married Gina Crossan, his partner for many years and the mother of his four children, at HM Prison Maze on February 21, 1997. She is three years Adair’s junior and grew up in the same Lower Oldpark neighbourhood. 

After being released, Adair is almost immediately arrested again for violently assaulting Gina, who suffers from ovarian cancer. Since this episode he reportedly moves to Scotland, living in Troon in Ayrshire.

In May 2006, Adair reportedly receives £100,000 from John Blake publishers for a ghost-written autobiography.

In November 2006, the UK’s Five television channel transmits an observational documentary on Adair made by Dare Films.

Adair appears in a documentary made by Donal MacIntyre and screened in 2007. The focus of the film centers around Adair and another supposedly reformed character, a Neo-Nazi from Germany called Nick Greger, and their trip to Uganda to build an orphanage. Adair is seen to fire rifles, stating it is the first time he has done so without wearing gloves. He also admits to being “worried sick” and “pure sick with worry” after Greger disappears in Uganda for days on end. It turns out that he had gone off and married a Ugandan lady. Adair confesses via telephone that he “thought something might have happened to Nick.”

On July 20, 2015, three Irish republicans, Antoin Duffy, Martin Hughes and Paul Sands, are found guilty of planning to murder Adair and Sam McCrory. Charges against one of the accused in the trial are dropped on July 1.

On September 10, 2016, Adair’s son, Jonathan Jr., is found dead in Troon, aged 32. He dies from an accidental overdose while celebrating the day after his release from prison for motoring offences. He had been in and out of prison since the family fled Northern Ireland. He served a five-year sentence for dealing heroin and crack cocaine. The year before, he had been cleared of a gun raid at a party and in 2012 is the target of a failed bomb plot. He was also facing trial later that year on drugs charges.

In December 2023, while recording a podcast with far-right activist Tommy Robinson, Adair surprisingly expresses a grudging respect for the IRA hunger strikers, describing the manner of their deaths as “dedication at the highest level” for a political cause and admitting that he would not have volunteered to do the same if asked.

Founding of the Criminal Assets Bureau

The Criminal Assets Bureau (CAB) (Irish: An Biúró um Shócmhainní Coiriúla), a law enforcement agency, is established in Ireland on October 15, 1996. The CAB has the powers to focus on the illegally acquired assets of criminals involved in serious crime. The aims of the CAB are to identify the criminally acquired assets of persons and to take the appropriate action to deny such people these assets. This action is taken particularly through the application of the Proceeds of Crime Act 1996. The CAB is established as a body corporate with perpetual succession and is founded on the multi-agency concept, drawing together law enforcement officers, tax officials, social welfare officials as well as other specialist officers including legal officers, forensic analysts and financial analysts. This multi-agency concept is regarded by some as the model for other European jurisdictions.

The CAB is not a division of the Garda Síochána (police) but rather an independent body corporate although it has many of the powers normally given to the Gardaí. The Chief Bureau Officer is drawn from a member of the Garda Síochána holding the rank of Chief Superintendent and is appointed by the Garda Commissioner. The remaining staff of the CAB are appointed by the Minister for Justice, Home Affairs and Migration. CAB members retain their original powers as if they were working within their separate entities and have direct access to information and databases that their original organisations are allowed by law. This ability to share information is described by the Garda Síochána Inspectorate in its Crime Investigation Report of October 2014 as “a good model that could be replicated outside of CAB.”

The CAB reports annually to the Minister through the Commissioner of the Garda Síochána and this report is laid before the Houses of the Oireachtas. The Minister for Justice, in publishing the 2011 CAB Annual Report, states: “The work of the bureau is one of the key law enforcement responses to tackling crime and the Government is very much committed to further strengthening the powers of the bureau through forthcoming legislative proposals.” In publishing the Bureau’s 2012 report, the Minister for Justice sets out: “The Annual Report provides an insight into the workings of the Bureau and highlights the advantage of adopting a multi-agency and multi-disciplinary approach to the targeting of illicit assets. The Bureau is an essential component in the State’s law enforcement response to serious and organised crime and the Government is fully committed to further strengthening its powers through future legislative reform.”

The Minister for Justice sets out that Ireland, through the work of the Bureau, has established itself as a jurisdiction that is responding to that challenge and the work of the Bureau is internationally recognised as a best practice approach to tackling criminality and the illicit monies it generates.

The CAB has been effective against organised criminals, especially those involved in the importation and distribution of drugs. It has also been used against corrupt public officials and terrorists.

The IRA “Supergrass” Trial Ends in Belfast

The “supergrass” trial of thirty-eight alleged members of the Irish Republican Army (IRA) ends in Belfast on August 5, 1983. The defendants face various charges including murder and attempted murder. Eighteen later have their convictions quashed. The trial has lasted 120 days with most of the evidence being offered by IRA supergrass Christopher Black. The judge jails twenty-two of the accused to sentences totaling more that 4,000 years. Four people are acquitted and others receive suspended sentences. In 1986, eighteen of the twenty-two who received prison sentences have their convictions quashed by the Court of Appeal.

Kevin Malgrew, who faces the most charges, eighty-four, is sentenced to jail terms totaling 963 years. When sentencing him, the judge, Justice Basil Kelly, says, “You are a ruthless terrorist. I do not expect any words of mine will ever raise in you a twinge of remorse.” 

In spite of the long sentences, none of those convicted is expected to spend more than twenty years in prison as the judge orders the terms should be served concurrently.

The IRA members are convicted largely on the evidence of a police informant, the so-called “supergrass” Christopher Black. He is granted immunity from prosecution and is believed to be abroad at the time the trial ends. A police spokesman says they believe Black is being hunted by the IRA.

Justice Kelly wears a bulletproof vest throughout the trial. Like all judges in such cases, he will receive police protection for the rest of his life.

But in spite of some of the long sentences he hands down, Justice Kelly also shows compassion to some of those on trial. He sets thirteen people free with suspended sentences or discharges saying he realises the “enormous pressure” placed upon them within their community to help extremists.

Postman Francis Murphy receives a suspended sentence for allowing an IRA man to wear his uniform so he could carry out a murder. And Justice Kelly gives Murphy’s mother an absolute discharge for having later burned the uniform. “Very many other mothers would have done the same,” he says.

Death of Fr. Des Wilson, Irish Catholic Priest & Church Dissident

Father Des Wilson, Irish Catholic priest and church dissident who in the course of the Northern Ireland Troubles embraces ideas and practice associated, internationally, with liberation theology, dies in his native Belfast on November 5, 2019. He believes the Word of God can never be silent in the face of oppression, injustice and suffering. He seeks to apply the ideas of liberation theology to the North, supporting and empowering marginalised communities, and acting as a voice for the voiceless.

Wilson is born in Belfast on July 8, 1925, the youngest of five sons to William Wilson, a publican and native of County Cavan, and his wife Emma (née McAvoy), a native of south County Down. He spends his earliest years above his father’s pub in Belfast, before the family moves to a house in the suburbs.

Wilson attends primary school locally, then receives secondary education at St. Malachy’s College. During his time there Belfast is blitzed in April and May 1941. Almost 1,000 are killed. The carnage he sees is a factor in his deciding on the priesthood.

After secondary school Wilson enters the seminary at St. Malachy’s, while studying English and Philosophy at Queen’s University Belfast. He proceeds to St. Patrick’s College, Maynooth, being ordained on June 19, 1949, for the Diocese of Down and Connor.

After ordination Wilson serves as chaplain in Belfast’s Mater Infirmorum Hospital, then spends 15 years in St. Malachy’s as spiritual director. Former pupils remember him as fair, and able to play jazz excellently on the organ.

Wilson lives out his beliefs, spending half a century in Belfast’s Ballymurphy estate, among the North’s most deprived, and one of the areas which suffers worst from the Troubles. There he plays a role in community development, establishing projects to provide employment in the area. He suffers, finding himself for years outside the official Catholic Church.

Wilson plays a significant role in providing adult education. He wants an education that does not just provide qualifications and open career paths but is psychologically liberating.

Life changes in 1966 when Wilson is moved to St. John’s Parish in West Belfast as a curate. Having come from a comfortable background in Ballymurphy, he is shocked by the poverty, the poor housing and the treatment of women. Unusual for a priest at the time, he moves into a terraced house in the estate. He finds the Catholic Church unable to respond to the multiple problems people are facing. That inability worsens as the Troubles erupt.

Wilson’s personal probity is so recognised that he is accepted as a mediator in feuds between the Provisional Irish Republican Army and Official Irish Republican Army in the 1970s and is able to broker permanent peace. He also helps bring about the ceasefires in the 1990s.

Wilson does not shirk unpopular stances. In the 1970s he refuses to condemn the Irish Republican Army (IRA). Later he says the conviction of former Real Irish Republican Army leader Michael McKevitt for directing terrorism is unsafe. He also publicly visits and supports a Ballymurphy couple which has a very bitter falling out with Sinn Féin, leading to a picket on their home.

By 1975 relations with his bishop has broken down and Wilson resigns but continues ministering in Ballymurphy. Forbidden to say Mass in a church, his pay cut off, he says Mass in his house. He suffers hardship, living from savings, some earnings from writing, broadcasting and lecturing, and help from Quaker and Presbyterian friends. By the early 1980s his Ballymurphy home becomes too small for the many classes he organises. His classes are rehoused and expanded as the Conway Education Centre in a vacant mill. He is able to offer a range of vocational and non-vocational courses with almost 1,000 students. In the mid-1980s his relationship with the Dioceses of Down and Connor is re-established, and he is allowed to continue his ministry.

Personally, Wilson has great gifts of head and heart and is incapable of rancour. A strong belief is that it is important to share food to talk, as happened in Biblical times. Thus, a lunch would last an afternoon.

Wilson dies on November 5, 2019, in Belfast. Instead of wreaths, he asks mourners to donate to the Ballymurphy Massacre Memorial Garden. The garden is dedicated to the victims of the Ballymurphy massacre of August 1971, which saw the killing in the district of eleven civilians by soldiers of the 1st Battalion, Parachute Regiment. The victims include Fr. Hugh Mullan, who had been a student of Wilson’s at St. Malachy’s. He was shot while going to the aid of a wounded man.

Following a Requiem Mass at Corpus Christi Church in Ballymurphy, Wilson is buried in Milltown Cemetery. Senior Sinn Féin politicians Gerry Adams and Michelle O’Neill are among those who take turns carrying his coffin.

Birth of Desmond “Des” O’Malley, Irish Politician

Desmond Joseph “Des” O’Malley, Fianna Fáil and Progressive Democrats politician, is born on February 2, 1939, in Limerick, County Limerick.

O’Malley is born into a storied Limerick political family. His maternal grandfather, Denis O’Donovan, is killed during the Irish War of Independence by the Black and Tans, two of his uncles and his father hold the office of Mayor of Limerick, and his uncle Donogh O’Malley is a Minister for Education. He is educated at the Jesuit Crescent College and at University College Dublin (UCD), from which he graduates with a degree in law in 1962.

In 1968, O’Malley enters politics upon the sudden death of his uncle Donogh who, at that the time, is the sitting Minister for Education. He is chosen after Donogh’s widow, Hilda, still in shock at the sudden death of her husband, turns down the opportunity to contest the by-election necessitated by his death.

O’Malley is subsequently elected as a Fianna Fáil TD for the Limerick East constituency in the by-election. Perhaps the first sign of the defiance that would define his career materialises during the 1969 Irish general election when Hilda asks her nephew to step aside and allow her to contest in the Limerick East constituency as the main Fianna Fáil candidate. He refuses and places third in the four-seat constituency, with his aunt, running as an independent, coming in fifth.

Following the general election, O’Malley is appointed Parliamentary Secretary to both Minister for Defence Jim Gibbons and Taoiseach Jack Lynch and serves as Government Chief Whip. In his role as a confidante of Lynch, the political lines within Fianna Fáil that put him on a collision course of over twenty years with Charles Haughey, are drawn. He plays a central role in the Arms Crisis prosecutions of Haughey and Neil Blaney in 1970. After their acquittals, the stage is set within Fianna Fáil for a long-term power struggle that eventually results in O’Malley’s expulsion from the party in 1984.

In the meantime, O’Malley’s next position within Lynch’s government comes when he is made Minister for Justice after Mícheál Ó Móráin is forced to resign due to ill-health. One of the most significant aspects of his legacy transpires during his tenure as Minister for Justice from 1970 to 1973. In response to the ongoing conflict in Northern Ireland, he tries and fails to introduce internment without trial for republicans within the State. He is, however, successful in reintroducing the Offences Against the State Act, which enables convictions for Irish Republican Amy (IRA) membership on the word of a Garda Superintendent, and the Special Criminal Court, a non-jury court presided over by three judges which tries cases of terrorism and serious organised crime.

When Lynch resigns the Fianna Fáil leadership following electoral defeat in 1979, O’Malley and Martin O’Donoghue manage the leadership campaign of George Colley, who subsequently loses to Haughey. Following Haughey’s ascent to leadership, O’Malley retains the industry and commerce ministerial portfolio he had been appointed to following the 1977 Irish general election.

In 1982, after Fianna Fáil loses its majority but stays in government by virtue of a confidence and supply agreement with Sinn Féin – The Workers Party and two independents, O’Malley is appointed Minister for Trade, Commerce and Tourism, but with the death of Colley and the loss of O’Donoghue’s seat, he becomes increasingly isolated within Fianna Fáil.

After the party whip is removed from him in 1984, amidst inter-party wrangling over the New Ireland Forum, O’Malley is expelled from the party the following year, the final straw being his famous “I stand by the Republic” speech in which he announces his intention to abstain on a vote regarding the liberalisation of the sales of contraceptives, which Fianna Fáil opposes.

O’Malley goes on to establish the Progressive Democrats, joined by Mary Harney (who had also been expelled by Fianna Fáil), and later by Fianna Fáil TDs Bobby Molloy and Pearse Wyse, as well as Fine Gael TD Michael Keating. In the 1987 Irish general election, the Progressive Democrats win fourteen seats, making them the third biggest party in the Dáil. Among those elected are O’Malley, his cousin Patrick O’Malley, Anne Colley, daughter of George Colley, Martin Gibbons, son of Jim Gibbons, Michael McDowell and Martin Cullen.

O’Malley’s animus for Haughey does not stop him from entering coalition with Fianna Fáil after the 1989 Irish general election, with him once again appointed Minister for Industry and Commerce. While in government, he finally witnesses the downfall of Haughey in 1992, when he is forced to resign over the emergence of new evidence concerning his tapping of journalists’ phones in the 1980s. The coalition with Fianna Fáil does not last long under new Taoiseach Albert Reynolds, with the Government collapsing after Reynolds accuses O’Malley of dishonesty during the Beef Tribunal.

O’Malley retires as leader of the Progressive Democrats in 1993, and the party moves into opposition, only to re-enter government with Fianna Fáil in 1997, where it remains upon O’Malley’s retirement from politics in 2002.

While the Progressive Democrats no longer exist, they are generally credited with the breaking up of the Fianna Fáil versus Fine Gael dichotomy of Irish politics that had dominated since the founding of the Free State. Since 1922, Irish governments have tended to be either single-party Fianna Fáil cabinets, be they minority or majority, or Fine Gael-led coalitions, typically involving the Labour Party. A Fine Gael-Labour coalition is in power at the time of the founding of the Progressive Democrats, and a single-party government or clear majority has not been won in Ireland since.

O’Malley dies in Dublin on July 21, 2021, at the age of 82, having been in poor health for some time. He is predeceased by his wife, Pat, and survived by their six children, four daughters including the former TD Fiona O’Malley, and two sons.

Perhaps O’Malley’s greatest legacy is the political reality of Ireland today: the low-tax, pro-business economic policies of the Progressive Democrats have been the dominant ideology in the State since the 1990s. Sinn Féin, the party most affected by his measures as Minister for Justice, no longer vote against the retention of the Offences Against the State Act and Special Criminal Court.

The Birmingham Pub Bombings

The Birmingham pub bombings are carried out on November 21, 1974, when bombs explode in two public houses in Birmingham, England, killing 21 people and injuring 182 others. The bombings are one of the deadliest acts of the Troubles, and the deadliest act of terrorism to occur in England between World War II and the 2005 London bombings.

In 1973, the Provisional Irish Republican Army (IRA) extends its campaign to mainland Britain, attacking military and symbolically important targets to both increase pressure on the British government, via popular British opinion, to withdraw from Northern Ireland and to maintain morale amongst their supporters. By 1974, mainland Britain sees an average of one attack — successful or otherwise — every three days.

In the early evening hours of November 21, at least three bombs connected to timing devices are planted inside two separate public houses and outside a bank located in and around central Birmingham. It is unknown precisely when these bombs were planted. If official IRA protocol of preceding attacks upon non-military installations with a 30-minute advance warning to security services is followed, and subsequent eyewitness accounts are accurate, the bombs would have been planted at these locations after 7:30 p.m. and before 7:47 p.m.

According to testimony delivered at the 1975 trial of the six men wrongly convicted of the bombings, the bomb planted inside the Mulberry Bush pub is concealed inside either a duffel bag or briefcase, whereas the bomb planted inside the Tavern in the Town is concealed inside a briefcase or duffel bag (possibly concealed within a large, sealed plastic bag) and Christmas cracker boxes. The remnants of two alarm clocks recovered from the site of each explosion leaves the possibility that two bombs had been planted at each public house. The explosion crater at each location indicates that if two bombs had been planted at each public house, they would each have been placed in the same location and likely the same container.

Reportedly, those who plant the bombs then walk to a preselected phone box to telephone the advance warning to security services. However, the phone box has been vandalised, forcing the caller to find an alternative phone box and thus shortening the amount of time police have to clear the locations.

At 8:11 p.m., an unknown man with a distinct Irish accent telephones the Birmingham Post newspaper. The call is answered by operator Ian Cropper. The caller says, “There is a bomb planted in the Rotunda and there is a bomb in New Street at the tax office. This is Double X,” before terminating the call. (“Double X” is an IRA code word given to authenticate any warning call.) A similar warning is also sent to the Birmingham Evening Mail newspaper, with the anonymous caller again giving the code word, but again failing to name the public houses in which the bombs had been planted.

The Rotunda is a 25-story office block, built in the 1960s, that houses the Mulberry Bush pub on its lower two floors. Within minutes of the warning, police arrive and begin checking the upper floors of the Rotunda, but they do not have sufficient time to clear the crowded pub at street level. At 8:17 p.m., six minutes after the first telephone warning had been delivered to the Birmingham Post, the bomb, which had been concealed inside either a duffel bag or briefcase located ner the rear entrance to the premises, explodes, devastating the pub. The explosion blows a 40-inch crater in the concrete floor, collapsing part of the roof and trapping many casualties beneath girders and concrete blocks. Many buildings near the Rotunda are also damaged, and pedestrians in the street are struck by flying glass from shattered windows. Several of the victims die at the scene, including two youths who had been walking past the premises at the moment of the explosion.

Ten people are killed in this explosion and dozens are injured, including many who lose limbs. Several casualties are impaled by sections of wooden furniture while others have their clothes burned from their bodies. A paramedic called to the scene of this explosion later describes the carnage as being reminiscent of a slaughterhouse. One fireman says that, upon seeing a writhing, “screaming torso,” he begs police to allow a television crew inside the premises to film the dead and dying at the scene, in the hope the IRA would see the consequences of their actions. However, the police refuse this request, fearing the reprisals would be extreme.

The Tavern in the Town is a basement pub on New Street located a short distance from the Rotunda and directly beneath the New Street Tax Office. Patrons there hear the explosion at the Mulberry Bush, but do not believe that the sound, described by one survivor as a “muffled thump,” is an explosion.

Police have begun attempting to clear the Tavern in the Town when, at 8:27 p.m., a second bomb explodes there. The blast is so powerful that several victims are blown through a brick wall. Their remains are wedged between the rubble and live underground electric cables that supply the city centre. One of the first police officers on the scene, Brian Yates, later testifies that the scene which greeted his eyes was “absolutely dreadful,” with several of the dead stacked upon one another, others strewn about the ruined pub, and several screaming survivors staggering aimlessly amongst the debris, rubble, and severed limbs. A survivor says the sound of the explosion is replaced by a “deafening silence” and the smell of burned flesh.

Rescue efforts at the Tavern in the Town are initially hampered as the bomb had been placed at the base of a set of stairs descending from the street, the sole entrance to the premises, had been destroyed in the explosion. The victims whose bodies are blown through a brick wall and wedged between the rubble and underground electric cables take up to three hours to recover, as recovery operations are delayed until the power can be isolated. A passing West Midlands bus is also destroyed in the blast.

This bomb kills nine people outright, and injures everyone in the pub, many severely. Two later die of their injuries. After the second explosion, police evacuate all pubs and businesses in Birmingham city centre and commandeer all available rooms in the nearby City Centre Hotel as an impromptu first-aid post. All bus services into the city centre are halted, and taxi drivers are encouraged to transport those lightly injured in the explosions to hospital. Prior to the arrival of ambulances, rescue workers remove critically injured casualties from each scene upon makeshift stretchers constructed from devices such as tabletops and wooden planks. These severely injured casualties are placed on the pavement and given first aid prior to the arrival of ambulance services.

At 9:15 p.m., a third bomb, concealed inside two plastic bags, is found in the doorway of a Barclays Bank on Hagley Road, approximately two miles from the site of the first two explosions. This device consists of 13.5 pounds of Frangex connected to a timer and is set to detonate at 11:00 p.m. The detonator to the device activates when a policeman prods the bags with his truncheon, but the bomb does not explode. The device is destroyed in a controlled explosion early the following morning.

The bombings stoke considerable anti-Irish sentiment in Birmingham, which then has an Irish community of 100,000. Irish people are ostracised from public places and subjected to physical assaults, verbal abuse and death threats. Both in Birmingham and across England, Irish homes, pubs, businesses and community centres are attacked, in some cases with firebombs. Staff at thirty factories across the Midlands go on strike in protest of the bombings, while workers at airports across England refuse to handle flights bound for Ireland. Bridget Reilly, the mother of the two Irish brothers killed in the Tavern in the Town explosion, is herself refused service in local shops.

The bombings are immediately blamed on the IRA, despite the organisation not having claimed responsibility. Due to anger against Irish people in Birmingham after the bombings, the IRA Army Council places the city “strictly off-limits” to IRA active service units. In Northern Ireland, loyalist paramilitaries launch a wave of revenge attacks on Irish Catholics and within two days of the bombings, five Catholic civilians have been shot dead by loyalists. The Provisional IRA never officially admits responsibility for the Birmingham pub bombings.

Six Irishmen are arrested within hours of the blasts and in 1975 are sentenced to life imprisonment for the bombings. The men, who become known as the Birmingham Six, maintain their innocence and insist police had coerced them into signing false confessions through severe physical and psychological abuse. After 16 years in prison, and a lengthy campaign, their convictions are declared unsafe and unsatisfactory, and quashed by the Court of Appeal in 1991. The episode is seen as one of the worst miscarriages of justice in British legal history.

In 2001, each of the Birmingham Six is subsequently paid between £840,000 and £1.2 million in compensation.

Establishment of the Special Criminal Court (SCC)

The Special Criminal Court (SCC), a juryless criminal court in Ireland which tries terrorism and serious organised crime cases, is established on May 26, 1972.

Article 38 of the Constitution of Ireland empowers Dáil Éireann to establish “special courts” with wide-ranging powers when the “ordinary courts are inadequate to secure the effective administration of justice.” The Offences against the State Act 1939 leads to the establishment of the Special Criminal Court for the trial of certain offences. The scope of a “scheduled offence” is set out in the Offences Against the State (Scheduled Offences) Order 1972.

On May 26, 1972, the Government of Ireland exercises its power to make a proclamation pursuant to Section 35(2) of the Offences against the State Act 1939 which leads to the establishment of the Special Criminal Court for the trial of certain offences. The current court is first established by the Dáil under the Offences against the State Act 1939 to prevent the Irish Republican Army (IRA) from subverting Ireland’s neutrality during World War II and the Emergency. The current incarnation of the Special Criminal Court dates from 1972, just after the Troubles in Northern Ireland began.

Although the court is initially set up to handle terrorism-related crime, its remit has been extended and it has been handling more organised crime cases after the Provisional Irish Republican Army ceasefire in the 1990s. For instance, members of the drugs gang which murdered journalist Veronica Guerin were tried in the Special Criminal Court.

Section 35(4) and (5) of the Offences against the State Act 1939 provide that if at any time the Government or the Parliament is satisfied that the ordinary courts are again adequate to secure the effective administration of justice and the preservation of public peace and order, a rescinding proclamation or resolution, respectively, shall be made terminating the Special Criminal Court regime. To date, no such rescinding proclamation or resolution has been promulgated. Following the introduction of a regular Government review and assessment procedure on January 14, 1997, reviews taking into account the views of the relevant State agencies are carried out on February 11, 1997, March 24, 1998, and April 14, 1999, and conclude that the continuance of the Court is necessary, not only in view of the continuing threat to State security posed by instances of violence, but also of the particular threat to the administration of justice, including jury intimidation, from the rise of organised and ruthless criminal gangs, principally involved in drug-related and violent crime.

The Special Criminal Court has been criticised by the Irish Council for Civil Liberties, Amnesty International and the United Nations Commission on Human Rights for its procedures and for being a special court, which ordinarily should not be used against civilians. Among the criticisms are the lack of a jury and the increasing use of the court to try organised “ordinary” crimes rather than the terrorist cases it was originally set up to handle. Critics also argue that the court is now obsolete since there is no longer a serious terrorist threat to the State, although others disagree and cite the continuing violence from dissident republican terrorism, international terrorism and serious gangland crime.

Under the law, the court is authorised to accept the opinion of a Garda Síochána chief-superintendent as evidence that a suspect is a member of an illegal organisation. However, the court has been reluctant to convict on the word of a garda alone, without any corroborating evidence.

The Sinn Féin political party in the past has stated that it is their intention to abolish the Special Criminal Court as they believed it was used to convict political prisoners in a juryless court, however Sinn Féin are no longer in favour of its abolition. Some prominent Sinn Féin members, including Martin Ferris and Martin McGuinness, have been convicted of offences by it. In 1973 McGuinness was tried at the SCC, which he refused to recognise, after being arrested near a car containing 250 pounds (110 kg) of explosives and nearly 5,000 rounds of ammunition. He was convicted and sentenced to six months imprisonment.

Introduction of the Special Powers Act 1922

The Civil Authorities (Special Powers) Act (Northern Ireland) 1922, often referred to simply as the Special Powers Act, is an Act introduced by the Parliament of Northern Ireland on April 7, 1922, shortly after the establishment of Northern Ireland, and in the context of violent conflict over the issue of the partition of Ireland. Its sweeping powers make it highly controversial, and it is seen by much of the Irish nationalist community as a tool of Ulster unionist oppression. The Act is eventually repealed by the Northern Ireland (Emergency Provisions) Act 1973, following the abolition of Northern Ireland’s parliament and the imposition of direct rule by the British government.

At the start of the twentieth century, the people of Ireland are divided into two mutually hostile factions. The much larger group (nationalists) are mostly Roman Catholic, identified primarily as Irish, and want some form of Irish home rule or independence from Britain. The smaller group (unionists), concentrated primarily in the province of Ulster, are mostly Protestant, identified primarily as British and are committed to remaining within the United Kingdom. In the years before World War I, both groups establish armed militias intended to enforce their aims and protect their communities from the other side’s militias. The British government resolves to partition Ireland in an effort to alleviate unionists and nationalists, with the six most Protestant counties of Ulster forming Northern Ireland while the rest of Ireland achieves self-rule. This is accepted by most unionists as the best deal they are likely to get, but bitterly disappoints many nationalists, especially those who live in the six counties which become Northern Ireland. Many nationalists on both sides of the border feel that their country has been unjustly divided, and for many decades the Irish government claims that Northern Ireland is rightfully its territory.

Partition is formally established with the Government of Ireland Act 1920. This also establishes the Parliament of Northern Ireland, which comes into being the following year. Partition is followed by high levels of inter-communal violence, especially in Belfast. The Irish Republican Army (IRA), although it spends most of these years fighting in the Irish Civil War, aims to use armed force to end partition and compel the United Kingdom to withdraw sovereignty from Northern Ireland.

The Special Powers Act is presented as being necessary to re-establish peace and law and order in Northern Ireland and enable the government to “take all such steps and issue all such orders as may be necessary for preserving the peace and maintaining order,” although it is specified that the ordinary course of law should be interfered with as little as possible. The Minister of Home Affairs is empowered to make any regulation felt necessary to preserve law and order in Northern Ireland. Anyone who breaks these regulations can be sentenced to up to a year in prison with hard labour, and in the case of some crimes, whipping. A special summary jurisdiction is enabled to hear cases involving such crimes. The Minister of Home Affairs is also permitted to forbid the holding of inquests if he feels this is required to preserve order and peace.

The Schedule to the Act specifies actions which the government can take in order to preserve peace, although the body of the Act enables the government to take any steps at all which it thinks necessary. Actions specified in the Schedule include the closing of licensed premises, the banning in any area of meetings and parades in public places, the closing of roads, the taking of any land or property, and the destruction of any building. The Schedule also forbids the spreading by word of mouth or text any “reports or…statements intended or likely to cause disaffection to subjects of His Majesty.”

Because it is presented as emergency legislation, the Special Powers Act is initially current for only one year and has to be renewed annually. In 1928, however, it is renewed for five years and when this period expires in 1933 the Act is made permanent. According to John Whyte, this happens because, from 1925, nationalist MPs begin sitting in the Stormont parliament which they had initially boycotted. Unsurprisingly, they object strenuously to the renewal of the Act, and it is felt by the Ulster Unionist Party Minister of Home Affairs that it would be better to make the Act permanent than for Parliament annually to “wrangle” over it.

Initially, regulations under the Act are used mostly to curb immediate violence and disorder. One of the most controversial of these is internment without trial, outlined in Paragraph 23 of the Schedule. In the period from May 1922 to December 1924, 700 republicans are interned under the Act.

Political violence declines dramatically by 1925, and the government gradually shifts its emphasis from broad measures designed to return civil order to the province to more preventative regulations aimed at suppressing the threat posed by republican aspirations. Regulations banning meetings and parades and restrictions on the flying of the Irish tricolour become more common. Between 1922 and 1950, the government bans nearly 100 parades and meetings, the vast majority of which are nationalist or republican. No loyalist gathering is ever directly banned under the Act, although a few are caught in blanket bans against parades or meetings in a particular area. From 1922 until 1972, 140 publications are banned, the vast majority of which express republican viewpoints.

After the troubles of the early 1920s has died down, the provision for internment is not used until the IRA’s border campaign of the 1950s, in which several hundred republicans are interned. Following the outbreak of the Troubles in 1968, many within the Protestant community call for the reintroduction of internment. This occurs in 1971 and authorises internment of those suspected to be involved in terrorism. Although there is loyalist as well as republican terrorists at this time, of the 1,981 men interned, only 107 are loyalists.

Internment ends in 1975 but is credited with increasing support and sympathy for the Provisional Irish Republican Army amongst the Catholic community and outside of Northern Ireland. It helps to create political tensions which culminate in the 1981 Irish Hunger Strike and the death of MP Bobby Sands. Imprisonment under anti-terrorism laws specific to Northern Ireland continue until the 1998 Good Friday Agreement, but these laws require the right to a fair trial be respected.

The Act encounters further controversy in the 1970s due to the deployment of the British Army in Northern Ireland and its role in maintaining order and similar policing-style duties. In 1972, the government is forced to amend the Act in order to legalise the detention of internees arrested by soldiers. Martin Meehan had been arrested after escaping from Crumlin Road Gaol and charged with escaping from lawful custody. At his trial he successfully argues that under the Special Powers Act a soldier has no power of arrest and, as such, he has the legal right to escape. He is awarded £800 in compensation for being illegally detained for twenty-three days.

The Funeral of Liam Cosgrave

The funeral of Liam Cosgrave, Taoiseach from 1973 to 1977, takes place in Dublin on October 7, 2017. In accordance with the wishes of the Cosgrave family, it is not a state funeral. The Requiem Mass takes place at the Church of the Annunciation in Rathfarnham with burial afterwards at Goldenbridge Cemetery in Inchicore, Dublin. Taoiseach Leo Varadkar, members of the Government, and former Taoisigh are in attendance at the ceremony in Rathfarnham. Cosgrave died on October 4, 2017, at the age of 97.

Born on April 13, 1920, Cosgrave has a 40-year political career and is part of the government which sees Ireland become a Republic in 1949. He also oversees Ireland joining the United Nations, addresses the United States Congress in 1976 and signs the Sunningdale Agreement in Northern Ireland which leads to a short-lived power-sharing executive in Belfast in 1972.

Following tributes from across the political spectrum in Ireland, the Cosgrave family, his three children, Mary, Liam and Ciaran, are offered a state funeral. At their request the funeral Mass and burial has some trappings of state, but it is a private service. His wife Vera died in 2016.

Ten military policemen carry the coffin of Cosgrave as his funeral begins in Dublin. Current Taoiseach Leo Varadkar and his predecessors Enda Kenny and Bertie Ahern are among those who attend the funeral Mass at the Church of the Annunciation in Rathfarnham. Members of the judiciary, Army and police also pay their respects.

Cosgrave is buried in Goldenbridge Cemetery, Inchicore, beside his father W.T. Cosgrave, a key figure in the foundation of the Irish Free State and an officer in the 1916 Easter Rising.

Cosgrave is Taoiseach from 1973-1977, some of the most turbulent years of the Northern Ireland Troubles. He has been described as a consistent and courageous voice against terrorism. He is at the head of government on the worst day of atrocities in the Troubles – the Dublin and Monaghan bombings on May 17, 1974, when loyalists kill 33 people, including a pregnant woman at full term.

Birth of Provisional IRA Member Seán Savage

Seán Savage, Provisional Irish Republican Army member who is shot dead by the British Army while attempting to plant a car bomb in Gibraltar, is born in Belfast on January 26, 1965.

Born into an Irish Republican family in the Kashmir area of Belfast, Savage is educated at St. Gall’s Primary School, and at St. Paul’s Secondary School in the Falls Road area of West Belfast.

In 1987 Savage and Daniel McCann shoot and kill two Royal Ulster Constabulary officers at Belfast docks. He is also the leader of an IRA attack that places a car bomb beneath the car of John McMichael, an Ulster loyalist paramilitary, in Lisburn in December 1987. McMichael dies of his injuries two hours after the blast.

In March 1988, Savage and McCann, along with another Provisional IRA member, Mairéad Farrell, are sent to the British overseas territory of Gibraltar to plant a bomb in the town area targeting a British Army band which parades weekly in front of The Convent, the official Governors’ residence. However, the British Government acquires information about the intended attack and specially dispatches a British Army detachment there to intercept it, in an operation that it code-names Operation Flavius.

On March 6, 1988 Savage, McCann and Farrell enter Gibraltar from across the Spanish border to carry out a reconnaissance of the target. Having conducted it, they are leaving Gibraltar on foot approaching the Spanish border in two separate parties, when Savage sees McCann and Farrell up ahead being confronted and shot dead by soldiers from the Special Air Service regiment. He turns around and flees, running back into Gibraltar town, closely pursued on foot by another SAS soldier. After a 300-yard chase the soldier catches up with Savage and shoots him dead beneath a beech tree in Smith Dorrien Avenue. Civilian witnesses to the incident state afterwards that Savage is repeatedly fired upon by the soldier that had run him down while he is lying on the ground seemingly incapacitated.

The IRA team is subsequently found to be unarmed at the time of their deaths. A hire car rented by them, converted into a car bomb containing 140 lbs. of Semtex, with a device timed to go off during the changing of the guard ceremony in Gibraltar, is found two days later by the Spanish Police, who had assisted the British Government in tracking the IRA team’s movements in its territory before it had entered Gibraltar.

The bodies of Savage, Farrell and McCann are repatriated to Northern Ireland, where a collective IRA-sponsored funeral is held for them on March 16, 1988 at the IRA plot in Milltown Cemetery in West Belfast. As the coffins are being lowered into the ground Michael Stone, an Ulster loyalist paramilitary, stages a single-handed attack upon the ceremony, throwing grenades and firing a handgun at mourners. The funeral immediately descends into chaos. One group of mourners pursues the retreating attacker, who continues to throw grenades and fire bullets, through the cemetery grounds. Three of the unarmed mourners are killed and scores are injured. Stone retreats onto the adjoining M1 motorway, where he is arrested.

A Gibraltar inquest into the deaths of Savage, McCann and Farrell concludes the three had been lawfully killed. In 1995, the European Court of Human Rights rules that the human rights of the three were infringed, and criticizes the British authorities for lack of control in the arrest operation. They also rule that the three had been engaged in an act of terrorism, and consequently dismissed unanimously the applicants’ claims for damages, for costs and expenses incurred in the Gibraltar Inquest and the remainder of the claims for just satisfaction.

A British television documentary, Death on the Rock (1988), is produced and broadcast about the failed IRA operation in Gibraltar, examining the details of the events, and raising doubts about aspects of the British Government’s statements about the circumstances of the shootings of the IRA team, and questioning whether excessive force had been used in the confrontation in line with persistent rumours in the British media at that time of a “Shoot to Kill” strategy being used against the Provisional IRA by the British Government.
