Death of Laurence Ginnell, Politician, Lawyer & Member of Parliament

Laurence GinnellIrish nationalist politicianlawyer and Member of Parliament (MP) of the House of Commons of the United Kingdom of Great Britain and Ireland, dies in the United States on April 17, 1923. He serves as member of the Irish Parliamentary Party (IPP) for North Westmeath at the 1906 United Kingdom general election. From 1910 he sits as an Independent Nationalist and at the 1918 United Kingdom general election in Ireland he is elected for Sinn Féin.

Ginnell is born in DelvinCounty Westmeath, in 1852, (baptised April 9, 1852) the son of Laurence Ginnell and Mary Monaghan and twin to Michael Ginnell. He is self-educated and is called to the Irish bar as well as the Bar of England and Wales. In his youth, he is involved with the Land War and acts as private secretary to John Dillon.

The last great social and agrarian campaign of the Irish home rule movement, the Ranch War (1906 and 1909), is largely led and organised by Ginnell from the central office of the United Irish League. He is elected an MP in 1906, takes his seat at Westminster and swears allegiance to Edward VII. On October 14, 1906, he launches the “war” at Downs, County Westmeath.

The purpose of the war is to bring relief to the large numbers of landless and smallholders, particularly in the West, who are relatively untouched by the Wyndham Land Act (1903) and by the larger policy of purchase. The strategy that Ginnell pursues is the Down’s Policy, or cattle driving, a proceeding designed to harass the prosperous grazier interests, whose “ranches” occupy large, under populated and under worked tracts. The Down’s Policy is also meant to draw public attention to the scandalous inequalities that survive in the Irish countryside. The conservatives within the home rule leadership are understandably suspicious about the revival of agrarian disturbances, but the mood of the party organisation is hardening in the aftermath of a disappointing devolution bill in May 1907, from the new Liberal government, so that it seems logical to turn to the traditional mechanism for reactivating the national question: agrarian agitation.

Ginnell’s cattle drives begin to tail off after the summer of 1908, and the agitation is finally dissolved with the passage of a 1909 Act by the Liberal Chief Secretary Augustine Birrell that allows the transfer to the Irish Land Commission of farmland by compulsory purchase, which is hailed by the national movement as an historic victory. In reality, the Ranch War involves an implosion within sectors of the Irish Parliamentary Party, as its leadership has not facilitated the working of the Wyndham Land Act in the first place because John Dillon and his like want conflict above victory.

In 1909, Ginnell is expelled from the Irish Parliamentary Party for the offence of asking to see the party accounts after which he sits as an Independent Nationalist. During this time, he is addressed frequently as “The MP for Ireland.” At Westminster, he is highly critical of the British government‘s war policy and its holding of executions of certain participants in the Easter Rising of 1916. On May 9, he accuses British Prime Minister H. H. Asquith, of “Murder” and is forcibly ejected from the Chamber. He visits many of the prisoners who are interned in various prisons in Wales and England.

In 1917, Ginnell campaigns to try to ensure the election of George Noble Plunkett in the North Roscommon by-election in which he defeats the IPP candidate on an abstentionist platform. Following the victory of Éamon de Valera in East Clare, while he is standing for Sinn Féin, on July 10, 1917, Ginnell joins Sinn Féin.

At the Sinn Féin ardfheis in 1917, at which the party is reconstituted as a republican party with de Valera as president, Ginnell and W. T. Cosgrave are elected Honorary Treasurers. He is imprisoned in March 1918 for encouraging land agitation and later deported to Reading Gaol. In the 1918 United Kingdom general election, he is elected as a Sinn Féin MP for the Westmeath constituency by comfortably defeating his IPP challenger. After his release from prison, he attends the proceedings of the First Dáil. Along with fellow TD James O’Mara, he is one of the only TDs to serve as a member in both the House of Commons and Dáil Éireann.

He is one of the few people to have served in the House of Commons and in the Oireachtas. He is appointed Director of Propaganda in the Second Ministry of the Irish Republic. After spending a year as a republican campaigner in Chicago, he is appointed the Representative of the Irish Republic in Argentina and South America by de Valera. He carries out his propaganda work here to distribute copies of the Irish Bulletin and to provide the Sinn Féin version of the conflict during the Irish War of Independence. On August 16, 1921, he returns home to attend the first meeting of the Second Dáil. He travels back to Argentina some months later to serve as the Representative of the Republic there.

Ginnell opposes the Anglo-Irish Treaty that is ratified by the Dáil in January 1922, and is elected as an anti-Treaty Sinn Féin TD at the 1922 Irish general election on the eve of the Irish Civil War.

On September 9, 1922, Ginnell is the only anti-Treaty TD to attend the inaugural meeting of the Provisional Parliament or Third Dáil. Before signing the roll, he says, “I want some explanation before I sign. I have been elected in pursuance of a decree by Dáil Éireann, which decree embodies the decree of May 20, 1922. I have heard nothing read in reference to that decree, nothing but an Act of a foreign Parliament. I have been elected as a member of Dáil Éireann. I have not been elected to attend any such Parliament. Will anyone tell me with authority whether it is…”.

Ginnell is at this point interrupted but resumes by saying that he will sign the roll and take his seat in the Assembly if the Assembly is Dáil Éireann. He is informed he is not allowed raise any such question until a Ceann Comhairle has been elected. He continues to ask questions regardless to which he gets no answer including his question: “Will any member of the Six Counties be allowed to sit in this Dáil?” W. T. Cosgrave moves at this point that he be excluded from the House. Ginnell protests, and he is dragged out by force.

De Valera later appoints Ginnell a member of his “Council of State,” a twelve-member body set up to advise him on the deteriorating situation in the civil war. He returns to the United States soon afterward to serve as the Republic‘s envoy in the country. He orders Robert Briscoe and some of his friends to take possession of the Consular Offices in Nassau Street, New York City, then in the hands of the Irish Free State Government, to obtain the list of the subscribers to the bond drive organized to aid the struggle in the War of Independence. At the time, a court case is ongoing to decide on who has the right to the funds: the newly installed Provisional Government or de Valera, as one of the three trustees among the anti-Treatyites.

Ginnell dies in Washington, D.C. on April 17, 1923, at the age of 71, still campaigning against the Anglo-Irish Treaty.

Birth of Éamon de Valera, Third President of Ireland

Éamon de Valera, Irish politician and patriot, is born George de Valero on October 14, 1882, in Lennox Hill, a neighborhood on the Upper East Side of Manhattan in New York City. He serves as Taoiseach (1932–48, 1951–54, 1957–59) and President of Ireland (1959–73). An active revolutionary from 1913, he becomes president of Sinn Féin in 1917 and founds the Fianna Fáil party in 1926. In 1937, he makes his country a sovereign state, renamed Ireland, or Éire. His academic attainments also inspire wide respect. He becomes chancellor of the National University of Ireland in 1921.

De Valera is the son of Catherine Coll, who is originally from Bruree, County Limerick, and Juan Vivion de Valera, described on the birth certificate as a Spanish artist born in 1853. His father dies when he is two years old. He Is then sent to his mother’s family in County Limerick, and studies at the local national school and at Blackrock College, Dublin. He graduates from the Royal University of Ireland and becomes a teacher of mathematics and an ardent supporter of the Irish language revival. In 1913, he joins the Irish Volunteers, which had been organized to resist opposition to Home Rule for Ireland.

In the 1916 Easter Rising in Dublin, de Valera commands an occupied building and is the last commander to surrender. Because of his American birth, he escapes execution by the British but is sentenced to penal servitude. Released in 1917 but arrested again and deported in May 1918 to England, where he is imprisoned, he is acclaimed by the Irish as the chief survivor of the uprising and in October 1917 is elected president of the Irish republican and democratic socialist Sinn Féin political party, which wins three-fourths of all the Irish constituencies in December 1918.

After a dramatic escape from HM Prison Lincoln in February 1919, de Valera goes in disguise to the United States, where he collects funds. He returns to Ireland before the Irish War of Independence ends with the truce that takes effect on July 11, 1921, and appoints plenipotentiaries to negotiate in London. He repudiates the Anglo-Irish Treaty of December 6, 1921, that they signed to form the Irish Free State, however, primarily because it imposes an oath of allegiance to the British crown.

After Dáil Éireann ratifies the treaty by a small majority in 1922, de Valera supports the republican resistance in the ensuing Irish Civil WarW. T. Cosgrave’s Irish Free State ministry imprisons him, but he is released in 1924 and then organizes a republican opposition party that does not sit in Dáil Éireann. In 1927, however, he persuades his followers to sign the oath of allegiance as “an empty political formula,” and his new Fianna Fáil (“Soldiers of Destiny”) party then enters the Dáil, demanding abolition of the oath of allegiance, of the governor-general, of the Seanad Éireann (senate) as then constituted, and of land-purchase annuities payable to Great Britain. The Cosgrave ministry is defeated by Fianna Fáil in 1932, and de Valera, as head of the new ministry, embarks quickly on severing connections with Great Britain. He withholds payment of the land annuities, and an “economic war” results. Increasing retaliation by both sides enables de Valera to develop his program of austere national self-sufficiency in an Irish-speaking Ireland while building up industries behind protective tariffs. In the new Constitution of Ireland, ratified by referendum in 1937, the Irish Free State becomes Ireland, a sovereign, independent democracy tenuously linked with the British Commonwealth (under the Executive Authority (External Relations) Act 1936) only for purposes of diplomatic representation.

De Valera’s prestige is enhanced by his success as president of the council of the League of Nations in 1932 and of its assembly in 1938. He also enters negotiations with British Prime Minister Neville Chamberlain in which he guarantees that he will never allow Ireland to be used as a base for attacking Britain in the event of war. This culminates in the Anglo-Irish defense agreement of April 1938, whereby Britain relinquishes the naval bases of Cobh, Berehaven, and Lough Swilly (retained in a defense annex to the 1921 treaty), and in complementary finance and trade treaties that end the economic war. This makes possible de Valera’s proclamation in September 1939, upon the outbreak of World War II, that Ireland will remain neutral and will resist attack from any quarter. In secret, however, de Valera also authorizes significant military and intelligence assistance to both the British and the Americans throughout the war. He realizes that a German victory will imperil Ireland’s independence, of which neutrality is the ultimate expression. By avoiding the burdens and destruction of the war, de Valera achieves a relative prosperity for Ireland in comparison with the war-torn countries of Europe, and he retains office in subsequent elections.

In 1948, a reaction against the long monopoly of power and patronage held by de Valera’s party enables the opposition, with the help of smaller parties, to form an interparty government under John A. Costello. Ironically, this precarious coalition collapses within three years after Ireland becomes a republic by means of the repeal of the Executive Authority (External Relations) Act 1936 and the severance of all ties with the British Commonwealth, an act de Valera had avoided. De Valera resumes office until 1954, when he appeals unsuccessfully for a fresh mandate, and Costello forms his second interparty ministry. No clearly defined difference now exists between the opposing parties in face of rising prices, continued emigration, and a backward agriculture. De Valera claims, however, that a strong single-party government is indispensable and that all coalitions must be weak and insecure. On this plea he obtains, in March 1957, the overall majority that he demands.

In 1959, de Valera agrees to stand as a candidate for the presidency. He resigns his position as Taoiseach and leader of the Fianna Fáil party. In June he is elected president, and is reelected in 1966. He retires to a nursing home near Dublin in 1973 and dies there on August 29, 1975.

De Valera’s career spans the dramatic period of Ireland’s modern cultural and national revolution. As an anticolonial leader, a skillful constitutionalist, and a symbol of national liberation, he dominates Ireland in the half century following the country’s independence.

The Statute of Westminster 1931 Receives Royal Assent

The Statute of Westminster 1931, an act of the Parliament of the United Kingdom that sets the basis for the relationship between the Dominions (now called Commonwealth realms) and the Crown, receives royal assent on December 11, 1931.

The statute increases the sovereignty of the self-governing Dominions of the British Empire from the United Kingdom. It also binds them all to seek each other’s approval for changes to monarchical titles and the common line of succession. The statute is effective either immediately or upon ratification. It thus becomes a statutory embodiment of the principles of equality and common allegiance to the Crown set out in the Balfour Declaration of 1926. As the statute removes nearly all of the British parliament’s authority to legislate for the Dominions, it is a crucial step in the development of the Dominions as separate, independent, and sovereign states.

The Irish Free State never formally adopts the Statute of Westminster, its Executive Council (cabinet) taking the view that the Anglo-Irish Treaty of 1921 has already ended Westminster‘s right to legislate for the Irish Free State. The Constitution of the Irish Free State gives the Oireachtas “sole and exclusive power of making laws.” Hence, even before 1931, the Irish Free State does not arrest British Army and Royal Air Force deserters on its territory, even though the UK believes post-1922 British laws give the Free State’s Garda Síochána the power to do so. The UK’s Irish Free State Constitution Act 1922 says, however, “[n]othing in the [Free State] Constitution shall be construed as prejudicing the power of [the British] Parliament to make laws affecting the Irish Free State in any case where, in accordance with constitutional practice, Parliament would make laws affecting other self-governing Dominions.”

Motions of approval of the Report of the Commonwealth Conference had been passed by Dáil Éireann and Seanad Éireann in May 1931 and the final form of the Statute of Westminster includes the Irish Free State among the Dominions the British Parliament cannot legislate for without the Dominion’s request and consent. Originally, the UK government wants to exclude from the Statute of Westminster the legislation underpinning the 1921 treaty, from which the Free State’s constitution had emerged. Executive Council President (Prime Minister) W. T. Cosgrave objects, although he promises that the Executive Council will not amend the legislation unilaterally. The other Dominions back Cosgrave and, when an amendment to similar effect is proposed at Westminster by John Gretton, parliament duly votes it down. When the statute becomes law in the UK, Patrick McGilligan, the Free State Minister for External Affairs, states, “It is a solemn declaration by the British people through their representatives in Parliament that the powers inherent in the Treaty position are what we have proclaimed them to be for the last ten years.” He goes on to present the statute as largely the fruit of the Free State’s efforts to secure for the other Dominions the same benefits it already enjoys under the treaty. The Statute of Westminster has the effect of granting the Irish Free State internationally recognised independence.

Éamon de Valera leads Fianna Fáil to victory in the 1932 Irish general election on a platform of republicanising the Free State from within. Upon taking office, he begins removing the monarchical elements of the Constitution, beginning with the Oath of Allegiance. De Valera initially considers invoking the Statute of Westminster in making these changes, but John J. Hearne advises him to not do so. Abolishing the Oath of Allegiance in effect abrogates the 1921 treaty. Generally, the British believe that this is morally objectionable but legally permitted by the Statute of Westminster. Robert Lyon Moore, a Southern Unionist from County Donegal, challenges the legality of the abolition in the Irish Free State’s courts and then appeals to the Judicial Committee of the Privy Council (JCPC) in London. However, the Free State has also abolished the right of appeal to the JCPC. In 1935, the JCPC rules that both abolitions are valid under the Statute of Westminster. The Irish Free State, which in 1937 is renamed Ireland, leaves the Commonwealth in 1949 upon the coming into force of The Republic of Ireland Act 1948.

The Statute of Westminster’s modified versions are now domestic law in Australia and Canada. It has been repealed in New Zealand and implicitly in former Dominions that are no longer Commonwealth realms.

The “German Plot”

On Friday, May 17, 1918, the British government orders the arrest and imprisonment of all leading members of Sinn Féin, claiming they were involved in a plan to import arms from Germany. The British cover for these arrests is a bogus “German Plot,” which has since been thoroughly discredited.

The “German Plot” is a spurious conspiracy that the Dublin Castle administration in Ireland claims to exist between the Sinn Féin movement and the German Empire in May 1918. Allegedly, the two factions conspire to start an armed insurrection in Ireland during World War I, which would divert the British war effort. The administration uses these claims to justify the internment of Sinn Féin leaders, who are actively opposing attempts to introduce conscription in Ireland and more Irishmen being used as cannon fodder in service to their oppressors.

The “plot” originates on April 12 when the British arrest Joseph Dowling after he is put ashore in County Clare by a German U-boat. Dowling is a member of the Irish Brigade, one of several schemes by Roger Casement to get German assistance for the 1916 Easter Rising. Dowling now claims that the Germans are planning a military expedition to Ireland. William Reginald Hall and Basil Thomson believe him and convince the authorities to intern all Sinn Féin leaders. One hundred fifty are arrested on the night of May 17–18 and taken to prisons in England, including Éamon de Valera, Arthur Griffith, Constance Markievicz and W. T. Cosgrave. The introduction of internment and conscription reflects a decision of the British cabinet to take a harder line on the Irish Question following the failure of the Irish Convention.

Historian Paul McMahon characterises the “Plot” as “a striking illustration of the apparent manipulation of intelligence in order to prod the Irish authorities into more forceful action.” Republicans are tipped off about the impending arrests, allowing some to escape capture while others choose to be taken in order to secure a propaganda victory. The internment is counterproductive for the British, imprisoning the more accommodating Sinn Féin leadership while failing to capture members of the Irish Republican Brotherhood who are more committed to physical force republicanism.

The British live to regret one man who slips through their fingers that spring. Michael Collins uses the months he might have spent in an English prison assembling and consolidating his control of an intelligence organisation and putting it on a more focused military footing that soon makes the Empire squeal.

Even at the time, the proposition that the Sinn Féin leadership are directly planning with the German authorities to open another military front in Ireland is largely seen as spurious. Irish nationalists generally view the “German Plot” not as an intelligence failure but as a black propaganda project to discredit the Sinn Féin movement, particularly to an uninformed public in the United States. McMahon comments that this belief is mistaken, and that the authorities acted honestly but on the basis of faulty intelligence. It is still a matter of study and conjecture what impact it had on U.S. foreign policy regarding the 1919 bid for international recognition of the Irish Republic.

Birth of Timothy Michael Healy, Politician, Journalist, Author & Barrister

Timothy Michael “Tim” Healy, Irish nationalist politician, journalist, author, barrister, and one of the most controversial Irish Members of Parliament (MPs) in the House of Commons of the United Kingdom of Great Britain and Ireland, is born in Bantry, County Cork on May 17, 1855.

Healy is the second son of Maurice Healy, clerk of the Bantry Poor Law Union, and Eliza Healy (née Sullivan). His elder brother, Thomas Healy (1854–1924), is a solicitor and Member of Parliament (MP) for North Wexford and his younger brother, Maurice Healy (1859–1923), with whom he holds a lifelong close relationship, is a solicitor and MP for Cork City.

Healy’s father is transferred in 1862 to a similar position in Lismore, County Waterford. He is educated at the Christian Brothers school in Fermoy, and is otherwise largely self-educated, in 1869, at the age of fourteen, he goes to live with his uncle Timothy Daniel Sullivan in Dublin.

Healy then moves to England in 1871, working first as a railway clerk and then from 1878 in London as parliamentary correspondent of The Nation, writing numerous articles in support of Charles Stewart Parnell, the newly emergent and more militant home rule leader, and his policy of parliamentary obstructionism. Healy takes part in Irish politics and becomes associated with Parnell and the Irish Parliamentary Party. After being arrested for intimidation in connection with the Irish National Land League, he is promptly elected as member of Parliament for Wexford Borough in 1880.

In Parliament, Healy becomes an authority on the Irish land question. The “Healy Clause” of the Land Law (Ireland) Act 1881, which protects tenant farmers’ agrarian improvements from rent increases imposed by landlords, not only makes him popular throughout nationalist Ireland but also wins his cause seats in Protestant Ulster. He breaks with Parnell in 1886 and generally remains at odds with subsequent leaders of the Irish Parliamentary Party, though he is a strong supporter of proposals for Irish Home Rule. Meanwhile, he is called to the Irish bar in 1884 and becomes a queen’s counsel in 1899.

Dissatisfied with both the Liberals and the Irish Nationalists after the Easter Rising in 1916, Healy supports Sinn Féin after 1917. He returns to considerable prominence in 1922 when, on the urging of the soon-to-be Irish Free State‘s Provisional Government of W.T. Cosgrave, the British government recommends to King George V that Healy be appointed the first “Governor-General of the Irish Free State,” a new office of representative of the Crown created in the 1921 Anglo-Irish Treaty and introduced by a combination of the Irish Free State Constitution and Letters Patent from the King.

Healy believes that he has been awarded the Governor-Generalship for life. However, the Executive Council of the Irish Free State decides in 1927 that the term of office of Governors-General will be five years. As a result, he retires from the office and public life in January 1928 and publishes his extensive two volume memoirs later in that year. Throughout his life he is formidable because he is ferociously quick-witted, because he is unworried by social or political convention, and because he knows no party discipline. Towards the end of his life, he becomes more mellowed and otherwise more diplomatic.

Healy dies on March 26, 1931, at the age of 75, in Chapelizod, County Dublin. He is buried in Glasnevin Cemetery in Dublin.
