Birth of Gaetano Alibrandi, Papal Nuncio to Ireland

Gaetano Alibrandi, a senior papal diplomat of the Catholic Church and former Personal Secretary to Giovanni Battista Cardinal Montini (later Pope Paul VI), is born on January 14, 1914, at Castiglione di Sicilia in the province of CataniaSicily.

Alibrandi is ordained priest on November 1, 1936, and obtains a Doctor of Divinity from the Pontifical Lateran University and a Doctorate on Civil and Canon Law. He enters the Diplomatic Corps of the Holy See in 1941, serving for five years in the Vatican Secretariat of State and is then a staff member in the apostolic nunciatures in Italy and Turkey before coming to Ireland as a counsellor at the Apostolic Nunciature for two years from 1954 to 1956. He later describes his first Irish posting as “a spiritual bath.”

In 1961, Alibrandi receives episcopal consecration as titular Archbishop of Binda by Cardinal Fernando Cento upon his appointment as Nuncio of Chile, followed quickly by similar appointments in Lebanon (1963). As Apostolic Nuncio to Chile, he leads the Chilean delegation to the Second Vatican Council.

This is a challenging time for the Catholic Church in Ireland, then led by Cardinal William Conway, as it adjusts to both the internal changes generated by the Second Vatican Council and the wider social changes. He is ill-suited to coping with these changes and in particular the violence in Northern Ireland. It is widely assumed that he sees to it that the more overtly nationalist Tomás Ó Fiaich is appointed to Armagh in 1977 after the death of Cardinal Conway. The journalist and author Ed Moloney in his book on the Irish Republican Army (IRA) asserts that Alibrandi’s “sympathy for the IRA was a constant source of friction with the government in London.”

Alibrani plays a major role in the 1971 decision by the Vatican to accept the resignation of John Charles McQuaid as Archbishop of Dublin. This comes as a shock to McQuaid, who expected that he would be allowed to remain for some time after the normal retirement age of 75.

In many of the episcopal appointments made while Alibrandi is nuncio, he favours doctrinally “sound,” right-of-centre priests and in the case of the Archdiocese of Dublin picks two priests, Kevin McNamara and Desmond Connell, who are notably ill-suited. In a profile of the Archbishop at the time of his retirement, T. P. O’Mahony observes in The Tablet, “although he rarely gave interviews, and never overtly intervened in policy-making or in public controversies, it is beyond dispute that Archbishop Alibrandi wielded considerable influence behind the scenes.”

The respected academic and church historian Dermot Keogh assessing this period argues that “there was a general view that the best candidates had not been appointed…that a number were not up to the job, that most of the appointees shared a defensive attitude to matters of church and state.”

Alibrandi has “a very testy relationship with three Taoisigh – Jack LynchLiam Cosgrave and Garret FitzGerald.” After reaching the retirement age of 75, he returns to his home town in Sicily where he dies on July 3, 2003. His funeral Mass was celebrated on Saturday in Castiglione di Sicilia by Archbishop Paolo Romeo, Apostolic Nuncio to Italy. A memorial Mass for Archbishop Alibrandi will be celebrated by Archbishop Giuseppe Lazzarotto, Apostolic Nuncio to Ireland, on Friday, 11 July at 19.30 in the Church of Our Lady Help of Christians, Navan Road, Dublin.

It is reported in September 2012 during the second Dr. Garret FitzGerald Memorial Lecture at University College Cork (UCC) by Seán Donlon, former secretary general at the Department of Foreign Affairs, that “It came to our [Department of Foreign Affairs] attention that a substantial amount in three bank accounts in Dublin [held by the archbishop] were way in excess of what was needed to run the nunciature. The source [of the money] appeared to be South America.” Donlon goes on to say, “Because of its size, we thought it appropriate to ask if the funds belonged to the Holy See.” When contacted for an answer, Alibrandi “quickly answered ‘no’ and that they belonged to ‘family’. When it was pointed out to him that the money was then liable under Irish taxation law to DIRT, he said he would retire shortly and the accounts would be closed.”

Founding of European Movement Ireland

European Movement Ireland (EM Ireland) (Irish: Gluaiseacht na hEorpa in Éirinn) is founded in Dublin on January 11, 1954. EM Ireland is an independent not-for-profit organisation that campaigns for every Irish person to get involved in the European Union (EU) and by doing so, help shape it. It is the oldest Irish organisation dealing with the EU, pre-dating Ireland’s membership of the European Economic Community (EEC) in 1973 by almost twenty years. The organisation is headed by Chief Executive Officer (CEO), Noelle Connell. Julie Sinnamon acts as Chair of the EM Ireland Board.

One hundred people meet in the Shelbourne Hotel in Dublin on January 11, 1954, and found the Irish Council of the European Movement. Signing the Articles of Association that found the EM Ireland are seven pioneers of Ireland’s future in Europe. They are: Donal O’Sullivan, university lecturerGarret FitzGerald, economist; Louis P. F. Smith, economist; Denis Corboy, barristerGeorge Colley, solicitorDeclan Costello, barrister; and Sean J. Healy, secretary.

These seven signatories lay the first stone paving Ireland’s way to full membership of the EU. The aim of the Irish Council is to inform Irish individuals and organisations about the EU. One of its primary objectives is for Ireland to gain membership of the European Communities (EC) (principally the European Economic Community (EEC), as the EU is then known). Former Taoisigh Garret FitzGerald and Jack Lynch, and former President Mary Robinson back the initiative. After a referendum is held on the Third Amendment of the Irish Constitution, which is overwhelmingly approved by voters in May 1972, Ireland joins the European Communities as a full member state on January 1, 1973.

The Irish Council later becomes European Movement Ireland. Today the organisation claims to act as source of information for Irish citizens regarding the work of the EU and its stated aim is to promote reasoned robust and fair debate about EU in Ireland.

EM Ireland retains an affiliation with the European Youth Parliament, a youth organization which runs events for secondary school age children along the structure of a mock European Parliament.

EM Ireland is part of a pan-European network. European Movement International is a lobbying association that coordinates the efforts of associations and national councils with the goal of promoting European integration, and disseminating information about it. It seeks to encourage and facilitate the active participation of citizens and civil society organisations in the European Union as it develops. The European Movement network is represented in over 41 countries and has over 20 international organisations as members. The current President of European Movement is the former MEP from BelgiumGuy Verhofstadt. Death of T. K. Whitaker, Economist, Politician and Civil Servant

Thomas Kenneth Whitaker, Irish economist, politician, diplomat and civil servant, dies in Blackrock, Dublin, on January 9, 2017, a month after his 100th birthday. He serves as Secretary of Ireland’s Department of Finance from 1956 to 1969, as Governor of the Central Bank of Ireland from 1969 to 1976 and as a Senator from 1977 to 1982, after being nominated by the Taoiseach. He is considered one of the most influential civil servants in the history of the Irish State, with his economic policies greatly influencing the development of modern Ireland.

Whitaker is born in Rostrevor, a small town in the south of County Down, to Roman Catholic parents on December 8, 1916, and is reared in DroghedaCounty Louth, in modest circumstances. Neither of his parents are from Ulster. His mother, Jane O’Connor, comes from Ballyguirey East, LabasheedaCounty Clare. His father, Edward Whitaker, hails from County Westmeath and is assistant manager of a linen mill. He receives his primary and secondary education at the local CBS in Drogheda. He studies mathematics, Celtic studies and Latin by correspondence course at University of London, and is awarded external degrees in economics: a bachelor’s degree in 1941 and a master’s degree in 1952.

In 1956, Whitaker is appointed Secretary of the Department of Finance, at the age of thirty-nine. His appointment takes place at a time when Ireland’s economy is in deep depressionEconomic growth is non-existent, inflation apparently insoluble, unemployment rife, living standards low and emigration at a figure not far below the birth rate. He believes that free trade, with increased competition and the end of protectionism, will become inevitable and that jobs will have to be created by a shift from agriculture to industry and services. He forms a team of officials within the department which produce a detailed study of the economy, culminating in a plan recommending policies for improvement. The plan is accepted by the government and is transformed into a white paper which becomes known as the First Programme for Economic Expansion, and quite unusually is published with his name attached in November 1958. The programme becomes known as the “Grey Book” which many argue brings the stimulus of foreign investment into the Irish economy. However, other reforms such as the Department of Industry and Commerce‘s export profits tax relief introduced in 1956, are opposed by Whitaker.

In 1977, Taoiseach Jack Lynch nominates Whitaker as a member of the 14th Seanad. He serves as a Senator from 1977 to 1981, where he sits as an independent member.

In 1981, Whitaker is nominated to the 15th Seanad by Taoiseach Garret FitzGerald, where he serves until 1982. FitzGerald also appoints him to chair a Committee of Inquiry into the Irish penal system, and he chairs a Parole Board or Sentence Review Group for several years.

Whitaker also serves as Chancellor of the National University of Ireland (NUI) from 1976 to 1996. He was also President of the Royal Irish Academy (RIA) and as such, a member of the Board of Governors and Guardians of the National Gallery of Ireland, from 1985 to 1987. He has a very strong love for the Irish language throughout his career and the collection of Irish poetry, An Duanaire: Poems of the Dispossessed 1600–1900, edited by Seán Ó Tuama and Thomas Kinsella is dedicated to Whitaker. From 1995 to 1996 he chairs the Constitution Review Group, an independent expert group established by the government, which publishes its report in July 1996.

Whitaker receives many national and international honours and tributes for his achievements during his lifetime, most notably the conferral of “Irishman of the 20th Century” in 2001 and Greatest Living Irish Person in 2002. In November 2014, the Institute of Banking confers an Honorary Fellowship on him and creates an annual T. K. Whitaker Scholarship in his name. In April 2015, he is presented with a lifetime achievement award by University College Dublin‘s Economics Society for his outstanding contribution to Ireland’s economic policy.

In November 2016, to mark his centenary year, Dún Laoghaire–Rathdown County Council acknowledges Whitaker’s “outstanding and progressive contribution to Irish public service and to society.” The Cathaoirleach of Dún Laoghaire–Rathdown, Cormac Devlin, presents a special award to Whitaker which is accepted by Ken Whitaker on behalf of his father.

Whitaker marries Nora Fogarty in 1941 and they have six children. After his wife’s death in 1994, he remarries, to Mary Moore in 2005. The couple is invited to Áras an Uachtaráin in 2006 for his 90th birthday by the President of Ireland Mary McAleese. Mary Moore Whitaker dies in 2008. T. K. Whitaker turns 100 in December 2016 and dies a month later on January 9, 2017, having survived both of his wives. He is buried at Shanganagh Cemetery, Shankill, Dublin.

The main administrative building in Dundalk Institute of Technology is named after him, the T.K. Whitaker Building. Whitaker Square in the Grand Canal Dock area of Dublin 2 is named in his honour. The offices of the Economic and Social Research Institute are located on the square.

Birth of Kate O’Connell, Former Fine Gael Politician

Katherine O’Connell (née Newman), a former Fine Gael politician who serves as a Teachta Dála (TD) for the Dublin Bay South constituency from 2016 to 2020, is born in KilbegganCounty Westmeath, on January 3, 1980. During her time in the Dáil, O’Connell campaigns in favour of abortion rights as well as pushes for more funding for healthcare services in Ireland.

From 1999 to 2003, O’Connell studies to be a pharmacist at the University of Brighton, graduating with an M Pharm in the United Kingdom. She then works as a hospital pre-registrar in the Surrey and Sussex Healthcare NHS Trust, before returning to Ireland to practice as a locum-pharmacist. By 2006, she and her husband open up their first pharmacy in Sandyford, and later open up pharmacies in Rathgar, and Rathfarnham.

O’Connell is a member of Dublin City Council for the local electoral area of Rathgar–Rathmines from 2014 to 2016.

O’Connell is selected by Fine Gael for the 2016 Irish general election to “recapture” their seat in Dublin Bay South from Lucinda Creighton, who had left the party in 2013 over her objection to the party’s position on abortion and in 2015 founded Renua, an anti-abortion party. During the campaign, O’Connell called Creighton’s anti-abortion views “incredibly sanctimonious” and suggests that Creighton is an “out of touch career politician” whose views on abortion are borne out of a lack of connection with the real world. The Irish Independent refers to these comments as O’Connell “tearing strips off” of Creighton. In the election, O’Connell is elected, while Creighton loses her seat.

In her time in the Dáil, O’Connell campaigns in favour of abortion rights as well as pushing for more funding for healthcare services in Ireland.

In October 2016, O’Connell responds to comments by the Archbishop of Dublin Diarmuid Martin that TDs should remember their faith when legislating for abortion in Ireland by stating, “I don’t see why the archbishop’s views are in any way relevant. I don’t see why Archbishop Martin should be getting involved in women’s health issues. It is the same as asking my four-year-old. They [the Church] are entitled to their opinion, but I don’t put any weight in them. I don’t see what involvement the Catholic Church should have in women’s health issues”.

In November 2017, O’Connell confronts Barry Walsh, a member of Fine Gael’s executive council, with a dossier of tweets documenting that he repeatedly and frequently derogates women politicians, often calling them bitches, including fellow members of Fine Gael. After the leader of Fine Gael and Taoiseach Leo Varadkar comments that Walsh should resign, he does so.

O’Connell loses her seat at the 2020 Irish general election, placing 5th in the 4-seat constituency. In an August 2020 interview, she attributes her loss, in part, to being the running mate of the Minister for HousingEoghan Murphy, in an election fought over an ongoing housing crisis in Ireland.

On May 7, 2021, O’Connell declares she will not seek to be the Fine Gael candidate for the 2021 Dublin Bay South by-election. She suggests she will not be able to win a party selection again due to her relationship with the Fine Gael leadership souring in the meantime, partially because of her vocal support of Simon Coveney over Leo Varadkar in the 2017 Fine Gael leadership election. She also suggests many local Fine Gael branch members in Dublin South Bay regard her as an outsider and a “parachute candidate” due to the fact she is originally from County Westmeath, and have turned against her over this. The Phoenix offers the view that O’Connell would not be nominated because she has turned the Fine Gael leadership against her while lobbying for her sister, Mary Newman Julian, to be the party’s candidate in a 2018 Seanad by-election. In particular, a meeting between her and Simon Coveney in which her expectations are read as entitled is cited as hurting her relationships. Fine Gael’s candidate in the by-election is James Geoghegan, who had previously left the party to join Lucinda Creighton in Renua, but returns to Fine Gael after that party collapsed. He loses the by-election to Labour‘s Ivana Bacik, a senator for Dublin University and veteran pro-choice campaigner.

In October 2024, O’Connell leaves Fine Gael to contest the next general election in Dublin Bay South as an independent candidate. She fails to be elected or to achieve the one-quarter of the quota necessary to recoup her election expenses.

O’Connell states her family, the Newmans, have been “involved in Fine Gael since the 1960s,” starting when her maternal grandfather ran for Fine Gael as a councillor. Her father, Michael Newman, is also a Fine Gael councillor while Fine Gael minister Patrick Cooney is considered a family friend. O’Connell states that growing up, she and her family were greatly influenced by the progressive politics of Fine Gael leader Garret FitzGerald. Her sister, Mary Newman Julian, is also active in politics and contests elections for the Dáil in Tipperary and for Seanad Éireann, while another sister, Theresa Newman, works for a period as O’Connell’s political adviser in Leinster House. Her brother-in-law, Hugh O’Connell, is a prominent political journalist and editor who has worked for several Irish publications.

In 2018, during debates in the Dáil regarding abortion, O’Connell discloses personal details of a traumatic pregnancy she herself had experienced. During the pregnancy, she is told her child has only a 10% chance of survival. This prompts her to consider terminating the pregnancy. Ultimately, she decides to continue the pregnancy. The child is born with organs outside of the body but survives the birth. She cites the difficult decisions made during that pregnancy as having greatly informed her views on abortion.

Birth of Michael Noonan, Former Fine Gael Politician

Michael Noonan, former Fine Gael politician, is born in Limerick, County Limerick, on May 21, 1943. He has been a member of every Fine Gael cabinet since 1982, serving in the cabinets of Garret FitzGeraldJohn Bruton and Enda Kenny.

The son of a local school teacher, Noonan is raised in Loughill, County Limerick. He is educated at the local National School and St. Patrick’s Secondary School in Glin, before studying to be a primary school teacher at St. Patrick’s CollegeDrumcondra, Dublin. He subsequently completes a BA and H.Dip. in English and Economics at University College Dublin (UCD). He begins to work as a secondary school teacher in Dublin. He develops an interest in politics from his mother, whose family had been heavily involved in Fine Gael at the local level in Limerick, and joins the Dublin branch of the party after graduating from university.

Having been involved in the local Fine Gael organisation in Limerick since the late 1960s, Noonan first holds political office in 1974, when he is elected as a member of Limerick County Council. Having built up a local profile he contests the 1981 Irish general election for the party and secures a seat in Limerick East. Upon taking his Dáil seat, he becomes a full-time politician, giving up his teaching post and resigning his seat on Limerick County Council. Though Fine Gael forms a coalition government with the Labour Party, as a first time Teachta Dála (TD), he remains on the backbenches. He serves as a TD from 1981 to 2020.

Noonan serves Minister for Justice from 1982 to 1986, Minister for Energy from January 1987 to March 1987, Minister for Industry and Commerce from 1986 to 1987, Minister for Health from 1994 to 1997, Leader of the Opposition and Leader of Fine Gael from 2001 to 2002, and Minister for Finance from 2011 to 2017.

In May 2017, Noonan announces he will be stepping down as Minister for Finance in the coming weeks when a new Taoiseach was appointed, and as a member of the Dáil at the next general election.

Noonan marries Florence Knightley, a native of CastlemaineCounty Kerry and a primary school teacher, in 1969. They have three sons (Tim, John and Michael) and two daughters (Orla and Deirdre). In May 2010, Noonan appears on RTÉ‘s The Frontline to talk about his wife’s battle with Alzheimer’s disease. Florence Noonan dies on February 23, 2012 of pneumonia.

Birth of Alan Dukes, Former Fine Gael Politician

Alan Martin Dukes, former Fine Gael politician, is born in Drimnagh, Dublin, on April 20, 1945. He holds several senior government positions and serves as a Teachta Dála (TD) from 1981 to 2002. He is one of the few TDs to be appointed a minister on their first day in the Dáil.

His father, James F. Dukes, is originally from Tralee, County Kerry, and is a senior civil servant and the founding chairman and chief executive of the Higher Education Authority (HEA), while his mother is from near Ballina, County Mayo.

The Dukes family originally comes from the north of England. His grandfather serves with the Royal Engineers in World War I and settles in County Cork and then County Kerry afterward where he works with the Post Office creating Ireland’s telephone network.

Dukes is educated by the Christian Brothers at Coláiste Mhuire, Dublin, and is offered several scholarships for third level on graduation, including one for the Irish language. His interest in the Irish language continues to this day, and he regularly appears on Irish-language television programmes.

On leaving school he attends University College Dublin (UCD), where he captains the fencing team to its first-ever Intervarsity title.

Dukes becomes an economist with the Irish Farmers’ Association (IFA) in Dublin in 1969. After Ireland joins the European Economic Community (EEC) in 1973, he moves to Brussels where he is part of the IFA delegation. In this role, he is influential in framing Ireland’s contribution to the Common Agricultural Policy (CAP). He is appointed as chief of staff to Ireland’s EEC commissioner Richard Burke, a former Fine Gael politician.

In the 1979 European Parliament election, Dukes stands as a Fine Gael candidate in the Munster constituency. He has strong support among the farming community, but the entry of T. J. Maher, a former president of the IFA, as an independent candidate hurts his chances of election. Maher tops the poll.

He stands again for Fine Gael at the 1981 Irish general election in the expanded Kildare constituency, where he wins a seat in the 22nd Dáil. On his first day in the Dáil, he is appointed Minister for Agriculture by the Taoiseach, Garret FitzGerald, becoming one of only eight TDs so appointed. He represents Kildare for 21 years.

This minority Fine Gael–Labour Party coalition government collapses in February 1982 on the budget but returns to power with a working majority in December 1982. Dukes is again appointed to cabinet, becoming Minister for Finance less than two years into his Dáil career.

He faces a difficult task as finance minister. Ireland is heavily in debt while unemployment and emigration are high. Many of Fine Gael’s plans are deferred while the Fine Gael–Labour Party coalition disagrees on how to solve the economic crisis. The challenge of addressing the national finances is made difficult by electoral arithmetic and a lack of support from the opposition Fianna Fáil party led by Charles Haughey. He remains in the Department of Finance until a reshuffle in February 1986 when he is appointed Minister for Justice.

Fine Gael fails to be returned to government at the 1987 Irish general election and loses 19 of its 70 seats, mostly to the new Progressive Democrats. Outgoing Taoiseach and leader Garret FitzGerald steps down and Dukes is elected leader of Fine Gael, becoming Leader of the Opposition.

This is a difficult time for the country. Haughey’s Fianna Fáil runs on promises to increase spending and government services, and attacking the cutbacks favoured by Fine Gael. However, on taking office, the new Taoiseach and his finance minister Ray MacSharry immediately draw up a set of cutbacks including a spate of ward and hospital closures. This presents a political opportunity for the opposition to attack the government.

However, while addressing a meeting of the Tallaght Chamber of Commerce, Dukes announces, in what becomes known as the Tallaght Strategy that: “When the government is moving in the right direction, I will not oppose the central thrust of its policy. If it is going in the right direction, I do not believe that it should be deviated from its course, or tripped up on macro-economic issues.”

This represents a major departure in Irish politics whereby Fine Gael will vote with the minority Fianna Fáil Government if it adopts Fine Gael’s economic policies for revitalising the economy. The consequences of this statement are huge. The Haughey government is able to take severe corrective steps to restructure the economy and lay the foundations for the economic boom of the nineties. However, at a snap election in 1989, Dukes does not receive electoral credit for this approach, and the party only makes minor gains, gaining four seats. The outcome is the first-ever coalition government for Fianna Fáil, whose junior partner is the Progressive Democrats led by former Fianna Fáil TD Desmond O’Malley.

The party’s failure to make significant gains in 1989 leaves some Fine Gael TDs with a desire for a change at the top of the party. Their opportunity comes in the wake of the historic 1990 Irish presidential election. Fine Gael chooses Austin Currie TD as their candidate. He had been a leading member of the Northern Ireland Civil Rights Association (NICRA) movement in the 1960s and had been a member of the Social Democratic and Labour Party (SDLP) before moving south.

Initially, Fianna Fáil’s Brian Lenihan Snr is the favourite to win. However, after several controversies arise, relating to the brief Fianna Fáil administration of 1982, and Lenihan’s dismissal as Minister for Defence midway through the campaign, the Labour Party’s Mary Robinson emerges victorious. To many in Fine Gael, the humiliation of finishing third is too much to bear and a campaign is launched against Dukes’ leadership. He is subsequently replaced as party leader by John Bruton.

Bruton brings Dukes back to the front bench in September 1992, shortly before the November 1992 Irish general election. In February 1994, Dukes becomes involved in a failed attempt to oust Bruton as leader and subsequently resigns from the front bench. Bruton becomes Taoiseach in December 1994 and Dukes is not appointed to cabinet at the formation of the government.

In December 1996, Dukes returns as Minister for Transport, Energy and Communications following the resignation of Michael Lowry. At the 1997 Irish general election, he tops the poll in the new Kildare South constituency, but Fine Gael loses office. He becomes Chairman of the Irish Council of the European Movement. In this position, he is very involved in advising many of the Eastern European countries who are then applying to join the European Union.

In 2001, Dukes backs Michael Noonan in his successful bid to become leader of Fine Gael.

After 21 years, Dukes loses his Dáil seat at the 2002 Irish general election. This contest sees many high-profile casualties for Fine Gael, including Deputy Leader Jim Mitchell, former deputy leader Nora Owen and others. Many local commentators feel that Dukes’ loss is due to a lack of attention to local issues, as he is highly involved in European projects and has always enjoyed a national profile.

He retires from frontline politics in 2002 and is subsequently appointed Director General of the Institute of International and European Affairs. He remains active within Fine Gael and serves several terms as the party’s vice-president. From 2001 to 2011, he is President of the Alliance française in Dublin, and in June 2004, the French Government appoints him an Officer of the Legion of Honour. In April 2004, he is awarded the Commander’s Cross of the Order of Merit of the Republic of Poland.

In December 2008, Dukes is appointed by Finance Minister Brian Lenihan Jnr as a public interest director on the board of Anglo Irish Bank. The bank is subsequently nationalised, and he serves on the board until the Irish Bank Resolution Corporation (IBRC) is liquidated in 2013.

From 2011 to 2013, Dukes serves as chairman of the Board of Irish Guide Dogs for the Blind. In 2011, he founds the think tank Asia Matters, which inks an agreement with the Chinese People’s Association for Friendship with Foreign Countries in May 2019.

Dukes has lived in Kildare since first being elected to represent the Kildare constituency in 1981. His wife Fionnuala (née Corcoran) is a former local politician and serves as a member of Kildare County Council from 1999 until her retirement in 2009. She serves as Cathaoirleach of the council from 2006 to 2007, becoming only the second woman to hold the position in the body’s one-hundred-year history. They have two daughters.

The Funeral of Tom O’Higgins, Former Chief Justice of Ireland

The funeral of Tom O’Higgins, former Chief Justice of Ireland and Minister for Health, takes place at St. Patrick’s Church in Monkstown, County Dublin, on February 27, 2003. He died two days earlier in Dublin.

O’Higgins is described at his removal as a great Christian gentleman whose secular activities were outstanding both to his country and to Europe.

The chief mourners in St. Patrick’s Church are joined by the President of Ireland, Mary McAleese, and many representatives of the judiciary and politics. The mourners are led by his widow Terry, his children Tom, Geraldine, Michael, Barry, Kevin, Derval and Shane, his thirty grandchildren, his brother Michael and sister Rosaleen.

The parish priest, Father Maurice O’Moore, tells many hundreds in the congregation that O’Higgins and his wife had been regular worshippers at the church.

“Tom was a man of deep faith and his demeanour at prayer was an inspiration to me personally and to parishioners. I think of him this evening as a man of faith, as a man of prayer and a great Christian gentleman. His secular activities through his legal expertise were outstanding both to his country and to Europe,” he says.

Father O’Moore adds that many tributes had been paid to O’Higgins in the media, and everybody can be proud of the contribution he made as an Irishman through his religious faith, his sincerity and love of his country.

Father Bruce Bradley SJ, a friend of the family, gives a reading from the Gospel.

At the removal, Taoiseach Bertie Ahern is represented by his aide-de-camp, Captain Ger O’Grady.

Attending from the judiciary are the Chief Justice Ronan Keane, the former Chief Justice Thomas Finlay, and many former Supreme Court and High Court judges, including Séamus Henchy, Anthony J. Hederman, Séamus Egan, Kevin Lynch and Donal Barrington who, like O’Higgins, was also a judge on the European Court of Justice.

Also attending is Harry Hill SC, retired master of the High Court, Feargus Flood, chairman of the Flood Tribunal, as well many Supreme Court and High Court judges and barristers. The director-general of the Law Society, Ken Murphy, is also present, as are many solicitors.

The world of politics is well represented, particularly by members of the Fine Gael party, for which O’Higgins was a Teachta Dála (TD) and minister in the 1940s and 1950s.

Two former taoisigh, Garret FitzGerald and Liam Cosgrave, attend. Also present is the leader of the Fine Gael party, Enda Kenny, and Tom Hayes, chairman of the Parliamentary Party, as well as many party TDs and former deputies.

Maureen Lynch, widow of former Fianna Fail Taoiseach Jack Lynch, and Dessie O’Malley, the former Progressive Democrats leader, also attend.

Internment in Shanganagh Cemetery in south County Dublin follows the 11:00 a.m. funeral Mass.

Death of John Costello, Fine Gael Politician & 3rd Taoiseach

John Aloysius Costello, Fine Gael politician who serves as Taoiseach from 1948 to 1951 and from 1954 to 1957, Leader of the Opposition from 1951 to 1954 and from 1957 to 1959, and Attorney General of Ireland from 1926 to 1932, dies in Ranelagh, Dublin, on January 5, 1976. He serves as a Teachta Dála (TD) from 1933 to 1943 and from 1944 to 1969.

Costello is born on June 20, 1891, in Fairview, Dublin, the younger son of John Costello senior, a civil servant, and Rose Callaghan. He is educated at St. Joseph’s, Fairview, and then moves to O’Connell School, for senior classes, and later attends University College Dublin (UCD), where he graduates with a degree in modern languages and law. He studies at King’s Inns to become a barrister, winning the Victoria Prize there in 1913 and 1914. He is called to the Irish Bar in 1914, and practises as a barrister until 1922.

In 1922, Costello joins the staff at the office of the Attorney General in the newly established Irish Free State. Three years later he is called to the inner bar, and the following year, 1926, he becomes Attorney General of Ireland, upon the formation of the Cumann na nGaedheal government, led by W. T. Cosgrave. While serving in this position he represents the Free State at Imperial Conferences and League of Nations meetings.

Costello is also elected a Bencher of the Honourable Society of King’s Inns. He loses his position as Attorney General of Ireland when Fianna Fáil comes to power in 1932. The following year, however, he is elected to Dáil Éireann as a Cumann na nGaedheal TD. Cumann na nGaedheal soon merges with other parties to form Fine Gael.

During the Dáil debate on the Emergency Powers Act 1939, Costello is highly critical of the Act’s arrogation of powers, stating that “We are asked not merely to give a blank cheque, but to give an uncrossed cheque to the Government.” He loses his seat at the 1943 Irish general election but regains it when Éamon de Valera calls a snap election in 1944. From 1944 to 1948, he is the Fine Gael front-bench Spokesman on External Affairs.

In 1948, Fianna Fáil has been in power for sixteen consecutive years and has been blamed for a downturn in the economy following World War II. The 1948 Irish general election results show Fianna Fáil short of a majority, but still by far the largest party, with twice as many seats as the nearest rival, Fine Gael. It appears that Fianna Fáil is headed for a seventh term in government. However, the other parties in the Dáil realise that between them, they have only one seat fewer than Fianna Fáil, and if they band together, they would be able to form a government with the support of seven Independent deputies. Fine Gael, the Labour Party, the National Labour Party, Clann na Poblachta and Clann na Talmhan join to form the first inter-party government in the history of the Irish state.

While it looks as if cooperation between these parties will not be feasible, a shared opposition to Fianna Fáil and Éamon de Valera overcomes all other difficulties, and the coalition government is formed.

Since Fine Gael is the largest party in the government, it has the task of providing a suitable candidate for Taoiseach. Naturally, it is assumed that its leader, Richard Mulcahy, will be offered the post. However, he is an unacceptable choice to Clann na Poblachta and its deeply republican leader, Seán MacBride. This is due to Mulcahy’s record during the Irish Civil War. Instead, Fine Gael and Clann na Poblachta agree on Costello as a compromise candidate. Costello had never held a ministerial position nor was he involved in the Civil War. When told by Mulcahy of his nomination, Costello is appalled, content with his life as a barrister and as a part-time politician. He is persuaded to accept the nomination as Taoiseach by close non-political friends.

During the campaign, Clann na Poblachta had promised to repeal the Executive Authority (External Relations) Act 1936 but does not make an issue of this when the government is being formed. However, Costello and his Tánaiste, William Norton of the Labour Party, also dislike the act. During the summer of 1948, the cabinet discusses repealing the act, however, no firm decision is made.

In September 1948, Costello is on an official visit to Canada when a reporter asks him about the possibility of Ireland leaving the British Commonwealth. For the first time, he declares publicly that the Irish government is indeed going to repeal the External Relations Act and declare Ireland a republic. It has been suggested that this is a reaction to offence caused by the Governor General of Canada at the time, Harold Alexander, 1st Earl Alexander of Tunis, who is of Northern Irish descent and who allegedly arranges to have placed symbols of Northern Ireland in front of Costello at an official dinner. Costello makes no mention of these aspects on the second reading of the Republic of Ireland Bill on November 24 and, in his memoirs, claims that Alexander’s behaviour had in fact been perfectly civil and could have had no bearing on a decision which had already been made.

The news takes the Government of the United Kingdom and even some of Costello’s ministers by surprise. The former had not been consulted and following the declaration of the Republic in 1949, the UK passes the Ireland Act that year. This recognises the Republic of Ireland and guarantees the position of Northern Ireland within the United Kingdom for so long as a majority there want to remain in the United Kingdom. It also grants full rights to any citizens of the Republic living in the United Kingdom. Ireland leaves the Commonwealth on April 18, 1949, when The Republic of Ireland Act 1948 comes into force. Frederick Henry Boland, Secretary of the Department of External Affairs, says caustically that the affair demonstrates that “the Taoiseach has as much notion of diplomacy as I have of astrology.” The British envoy, John Maffey, 1st Baron Rugby, is equally critical of what he calls a “slipshod and amateur” move.

Many nationalists now see partition as the last obstacle on the road to total national independence. Costello tables a motion of protest against partition on May 10, 1949, without result.

In 1950, the independent-minded Minister for Health, Noël Browne, introduces the Mother and Child Scheme. The scheme would provide mothers with free maternity treatment and their children with free medical care up to the age of sixteen, which is the normal provision in other parts of Europe at that time. The bill is opposed by doctors, who fear a loss of income, and Roman Catholic bishops, who oppose the lack of means testing envisaged and fear the scheme could lead to birth control and abortion. The cabinet is divided over the issue, many feeling that the state cannot afford such a scheme priced at IR£2,000,000 annually. Costello and others in the cabinet make it clear that in the face of such opposition they will not support the Minister. Browne resigns from the government on April 11, 1951, and the scheme is dropped. He immediately publishes his correspondence with Costello and the bishops, something which had hitherto not been done. Derivatives of the Mother and Child Scheme are introduced in Public Health Acts of 1954, 1957 and 1970.

The Costello government has a number of noteworthy achievements. A new record is set in housebuilding, the Industrial Development Authority and Córas Tráchtála are established, and the Minister for Health, Noel Browne, with the then new Streptomycin, bring about an advance in the treatment of tuberculosis. Ireland also joins a number of organisations such as the Organization for European Economic Co-operation and the Council of Europe. However, the government refuses to join NATO, allegedly because the British remain in Northern Ireland. The scheme to supply electricity to even the remotest parts of Ireland is also accelerated.

While the “Mother and Child” incident does destabilise the government to some extent, it does not lead to its collapse as is generally thought. The government continues; however, prices are rising, a balance of payments crisis is looming, and two TDs withdraw their support for the government. These incidents add to the pressure on Costello and so he decides to call a general election for June 1951. The result is inconclusive but Fianna Fáil returns to power. Costello resigns as Taoiseach. It is at this election that his son Declan is elected to the Dáil.

Over the next three years while Fianna Fáil is in power a dual-leadership role of Fine Gael is taking place. While Richard Mulcahy is the leader of the party, Costello, who has proved his skill as Taoiseach, remains as parliamentary leader of the party. He resumes his practice at the Bar. In what is arguably his most celebrated case, the successful defence of The Leader against a libel action brought by the poet Patrick Kavanagh, dates from this period. Kavanagh generously praises Costello’s forensic skill, and the two men become friends.

At the 1954 Irish general election Fianna Fáil loses power. A campaign dominated by economic issues results in a Fine Gael-Labour Party-Clann na Talmhan government coming to power. Costello is elected Taoiseach for the second time.

The government can do little to change the ailing nature of Ireland’s economy, with emigration and unemployment remaining high, and external problems such as the Suez Crisis compounding the difficulty. Measures to expand the Irish economy such as export profits tax relief introduced in 1956 would take years have sizable impact. Costello’s government does have some success with Ireland becoming a member of the United Nations in 1955, and a highly successful visit to the United States in 1956, which begins the custom by which the Taoiseach visits the White House each Saint Patrick’s Day to present the U.S. President with a bowl of shamrock. Although the government has a comfortable majority and seems set for a full term in office, a resumption of Irish Republican Army (IRA) activity in Northern Ireland and Great Britain causes internal strains. The government takes strong action against the republicans.

In spite of supporting the government from the backbenches, Seán MacBride, the leader of Clann na Poblachta, tables a motion of no confidence, based on the weakening state of the economy and in opposition to the government’s stance on the IRA. Fianna Fáil also tables its own motion of no confidence, and rather than face almost certain defeat, Costello again asks President Seán T. O’Kelly to dissolve the Oireachtas. The general election which follows in 1957 gives Fianna Fáil an overall majority and starts another sixteen years of unbroken rule for the party. Some of his colleagues questioned the wisdom of his decision to call an election. The view is expressed that he was tired of politics and depressed by his wife’s sudden death the previous year.

Following the defeat of his government, Costello returns to the bar. In 1959, when Richard Mulcahy resigns the leadership of Fine Gael to James Dillon, he retires to the backbenches. He could have become party leader had he been willing to act in a full-time capacity. He remains as a TD until 1969, when he retires from politics, being succeeded as Fine Gael TD for Dublin South-East by Garret FitzGerald, who himself goes onto to become Taoiseach in a Fine Gael-led government.

During his career, Costello is presented with a number of awards from many universities in the United States. He is also a member of the Royal Irish Academy from 1948. In March 1975, he is made a freeman of the city of Dublin, along with his old political opponent Éamon de Valera. He practises at the bar until a short time before his death at the age of 84, in Ranelagh, Dublin, on January 5, 1976. He is buried at Dean’s Grange Cemetery in Dublin.

Birth of Thomas Finlay, Judge, Politician & Barrister

Thomas Aloysius Finlay, Irish judge, politician and barrister, is born on September 17, 1922, in Blackrock, Dublin. He serves as a Teachta Dála (TD) for the Dublin South-Central constituency from 1954 to 1957, a Judge of the High Court from 1971 to 1985, President of the High Court from 1974 to 1985 and Chief Justice of Ireland and a Judge of the Supreme Court from 1985 to 1994.

Finlay is the second son of Thomas Finlay, a politician and senior counsel whose career is cut short by his early death in 1932. He is educated at Clongowes Wood College, University College Dublin (UCD) and King’s Inns. While attending UCD, he is elected Auditor of the University College Dublin Law Society. His older brother, William Finlay, serves as a governor of the Bank of Ireland.

Finlay is called to the Bar in 1944, practicing on the Midlands circuit and becomes a senior counsel in 1961.

Finlay is elected to Dáil Éireann as a Fine Gael TD for the Dublin South-Central constituency at the 1954 Irish general election. He loses his seat at the 1957 Irish general election.

Following his exit from politics in 1957, having lost his Dáil seat, Finlay resumes practicing as a barrister. He successfully defends Captain James Kelly in the infamous 1970 arms trial.

In 1971, Finlay is tasked by the Fianna Fáil government with representing Ireland before the European Commission of Human Rights, when, in response to the ill treatment of detainees by security forces in Northern Ireland, they charge the British government with torture. Despite the notional recourse such prisoners would have within the British legal system, the Commission rules the complaint admissible.

Finlay is subsequently appointed a High Court judge and President of the High Court in January 1974. In 1985, Taoiseach Garret FitzGerald and his government nominates him to the Supreme Court and to the office of Chief Justice of Ireland. On October 10, 1985, he is appointed by President Patrick Hillery to both roles.

During this period Finlay presides over a number of landmark cases, including Attorney General v X in 1992, when he overturns a High Court injunction preventing a pregnant teenage rape victim travelling to the UK for an abortion.

When, in the same year, Judge Liam Hamilton of the High Court, chair of the Beef Tribunal, seeks disclosure of the cabinet’s minutes for a particular meeting, Chief Justice Finlay along with the majority of the Supreme Court deny the request ruling that the concept of collective government responsibility in the Constitution takes precedence.

Finlay announces his resignation as Chief Justice of Ireland and retirement as a judge in 1994.

After his retirement, Finlay presides over a number of public inquiries.

In 1996, Finlay oversees the inquiry into the violence by English fans at the aborted 1995 friendly soccer match versus the Republic of Ireland at Lansdowne Road. His report to Bernard Allen, Minister for Sport, is critical of security arrangements on the night and recommends improvements to ticketing, seat-allocation, fan-vetting and policing arrangements. The Irish Government shares his report with the British Home Office.

After the collapse of The Irish Press group in 1995, the Minister for Enterprise and Employment, John Bruton, receives a damming report from the Competition Authority that Independent Newspapers has abused its dominant position and acted in an anti-competitive manner by purchasing a shareholding in The Irish Press. In September 1995, Bruton announces the Commission on the Newspaper Industry with an extremely wide remit to examine diversity and ownership, competitiveness, editorial freedom and standards of coverage in Irish newspapers as well as the impact of the sales of the British press in Ireland. Minister Bruton appoints 21 people to the commission and appoints Finlay chair. Due to the wide remit and huge number of submissions, the commission’s report is delayed but is eventually published at the end of July recommending widespread reforms.

Following the discovery of the BTSB anti-D scandal, in 1996, Finlay is appointed the chair and singular member of the Tribunal of Inquiry into the Blood Transfusion Service Board. The speed and efficiency with which his BTSB Tribunal conducts its business, restores confidence in the Tribunal as a mechanism of resolving great controversies in the public interest.

Finlay also sits on an Irish Rugby Football Union (IRFU) panel to adjudicate on the cases of Rugby players accused of using banned performance-enhancing substances.

Finlay is married to Alice Blayney, who predeceases him in 2012. They have five children, two of whom follow in his family’s legal tradition: his son John being a Senior Counsel and his daughter Mary Finlay Geoghegan a former judge of the High Court, Court of Appeal and Supreme Court. Whenever his work schedule allows, he escapes to County Mayo where he indulges his passion for fishing.

Thomas Finlay dies at the age of 95 in Irishtown, Dublin, on December 3, 2017.

28th Amendment of the Constitution Bill 2008 Rejected by Irish Voters

The Twenty-eighth Amendment of the Constitution Bill 2008, a proposed amendment to the Constitution of Ireland, is rejected by voters on June 12, 2008, by a margin of 53.4% to 46.6%, with a turnout of 53.1%. The purpose of the proposed amendment is to allow the state to ratify the Treaty of Lisbon of the European Union.

The treaty had been intended to enter into force on January 1, 2009, but has to be delayed following the Irish rejection. However, the Lisbon treaty is approved by Irish voters when the Twenty-eighth Amendment of the Constitution of Ireland is approved in the second Lisbon referendum, held in October 2009.

The Treaty of Lisbon is signed by the member states of the European Union on December 13, 2007. It is in large part a revision of the text of the Treaty establishing a Constitution for Europe (TCE) after its rejection in referendums in France in May 2005 and in the Netherlands in June 2005. The Treaty of Lisbon preserves most of the content of the Constitution, especially the new rules on the functioning of the European Institutions but gives up any symbolic or terminologic reference to a constitution.

Because of the decision of the Supreme Court of Ireland in Crotty v. An Taoiseach (1987), an amendment to the Constitution is required before it can be ratified by Ireland. Ireland is the only one of the then fifteen EU member states to put the Treaty to the people in a referendum. Ratification of the Treaty in all other member states is decided upon by national parliaments alone.

On February 26, 2008, the Government of Ireland approves the text of the changes to the constitution. The Twenty-eighth Amendment of the Constitution Bill is proposed in Dáil Éireann by Minister for Foreign Affairs Dermot Ahern on April 2, 2008. It passes final stages in the Dáil on April 29, with Sinn Féin TDs and Independent TD Tony Gregory rising against, but with insufficient numbers to call a vote. It passes final stages in the Seanad on May 7.

A Referendum Commission is established by Minister for the Environment, Heritage and Local Government John Gormley. It is chaired by former High Court judge Iarfhlaith O’Neill. Its role is to prepare one or more statements containing a general explanation of the subject matter of the proposal and of the text of the proposal in the amendment bill.

The government parties of Fianna Fáil and the Progressive Democrats are in favour of the treaty, but the other government party, the Green Party, is divided on the issue. At a special convention on January 19, 2008, the leadership of the Green Party fails to secure a two-thirds majority required to make support for the referendum official party policy. As a result, the Green Party itself does not participate in the referendum debate, although individual members are free to be involved in whatever side they chose. All Green Party members of the Oireachtas support the Treaty. The main opposition parties of Fine Gael and the Labour Party are also in favour. Only one party represented in the Oireachtas, Sinn Féin, is opposed to the treaty, while minor parties opposed to it include the Socialist Party, the Workers’ Party and the Socialist Workers Party. Independent TD’s Tony Gregory and Finian McGrath, Independent MEP Kathy Sinnott, and Independent members of the Seanad from the universities David Norris, Shane Ross and Rónán Mullen advocate a “No” vote as well.

The Government sends bilingual booklets written in English and Irish, explaining the Treaty, to all 2.5 million Irish households. However, compendiums of the two previous treaties, of which the Lisbon Treaty is intended to be a series of reforms and amendments, remain unavailable in Ireland. Some commentators argue that the treaty remains essentially incomprehensible in the absence of such a compendium.

On March 12, 2008, the Libertas Institute, a lobby group started by businessman Declan Ganley, launches a campaign called Facts, not politics which advocates a “No” vote in the referendum. A month later, the German Chancellor, Angela Merkel, appeals to Irish people to vote “Yes” in the referendum while on a visit to Ireland. The anti-Lisbon Treaty campaign group accuses the government and Fine Gael of a U-turn on their previous policy of discouraging foreign leaders from visiting Ireland during the referendum campaign. The European Commissioner for Internal Market Charlie McCreevy admits he had not read the Treaty from cover to cover and says, “he would not expect any sane person to do so.”

At the start of May, the Irish Alliance for Europe launches its campaign for a “Yes” vote in the referendum this consists of trade unionists, business people, academics and politicians. Its members include Garret FitzGerald, Ruairi Quinn, Pat Cox and Michael O’Kennedy. The Taoiseach Brian Cowen states that should any member of the Fianna Fáil parliamentary party campaign against the treaty, they will likely be expelled from the party.

On May 21, 2008, the executive council of the Irish Congress of Trade Unions votes to support a “Yes” vote in the referendum. Rank and file members of the individual unions are not balloted, and the Technical, Engineering and Electrical Union (TEEU) advises its 45,000 members to vote “No.” The Irish bishops conference states the Catholic Church‘s declaration that the treaty will not weaken Ireland’s constitutional ban on abortion, however the conference does not advocate either a “Yes” or “No” vote. By the start of June, Fianna Fáil, Fine Gael and the Labour Party have united in their push for a “Yes” vote despite earlier divisions. The two largest farming organisations, the Irish Creamery Milk Suppliers Association (ICMSA) and the Irish Farmers’ Association call for a “Yes” vote, the latter giving its support after assurances from Taoiseach Brian Cowen that Ireland will use its veto in Europe if a deal on World Trade reform is unacceptable.

There were 3,051,278 voters on the electoral register. The vast majority of voting takes place on Thursday, June 12, between 7:00 a.m. and 10:00 p.m. Counting begins at 9:00 a.m. the following morning. Several groups vote before the standard polling day, with some casting postal votes before June 9. These include members of the Irish Defence Forces serving in United Nations peacekeeping missions, Irish diplomats and their spouses abroad, members of the Garda Síochána, those unable to vote in person due to physical illness or disability, those who are unable to vote in person due to their employment (including students) and prisoners.

On June 9, several islands off the coast of County Donegal vote: Tory Island, Inishfree, Gola, Inishbofin and Arranmore. These islands are all part of the Donegal South-West constituency. Around 37% of the 745 eligible votes. Two days later, several islands off the coast of counties Galway and Mayo vote: the Aran Islands (Inis Mór, Inis Meáin and Inis Oírr) and Inishboffin form part of Galway West constituency, while Inishturk, Inishbiggle and Clare Island form part of the Mayo constituency. The Galway islands have 1,169 eligible voters, while the Mayo islands have 197.

Votes are counted separately in each Dáil constituency. The overall verdict is formally announced by the Referendum Returning officer in Dublin Castle by accumulating the constituency totals.
