Birth of Joseph Devlin, Journalist & Influential Nationalist Politician

Joseph Devlin, journalist and nationalist leader, is born on February 13, 1871, at Hamill Street in the Lower Falls area of Belfast, fourth son of Charles Devlin, car driver, and Elizabeth Devlin (née King), both recent migrants from the Lough Neagh area of east County Tyrone. He is educated at St. Mary’s Christian Brothers’ Grammar School in Divis Street until he is twelve. He proceeds to employment in Kelly’s Cellars public house near the city centre. From this unpromising background, he rises through a combination of ability, connections, and ambition to journalism with The Irish News (1891–93) and Freeman’s Journal (1895) and political position.

In his early years, Devlin is active in various local debating societies, where his associates include Cathal O’Byrne, who he retains a personal friendship despite later political differences. A committee member of the Belfast branch of the Irish National League (INL) in 1890, he joins the anti-Parnellite faction during the O’Shea divorce scandal (1891), becoming local secretary of the Irish National Federation (INF). His political model at this time is Thomas Sexton, MP for Belfast West, whose campaign he organises at the 1892 United Kingdom general election.

Although Healyism is strong in Catholic Ulster, Devlin aligns himself with the faction led by John Dillon and, from 1899, with the United Irish League (UIL), founded by William O’Brien. From the late 1890s this brings Devlin into conflict with the Belfast Catholic Association of Dr. Henry Henry, bishop of Down and Connor (1895–1908). This organisation, though sometimes regarded as Healyite, is essentially based on the view that mass nationalist political mobilisation in Belfast can only bring trouble and ostracism, and that Catholic interests are best represented by allowing a small group of lay and clerical notables to broker concessions from the unionist majority. After a series of local election contests in Catholic wards and controversies between the pro-Devlin weekly Northern Star and the clerically controlled The Irish News, Devlin succeeds in marginalising the politically maladroit Henry by 1905. In the process, however, he takes on some of the qualities of his “Catholic establishment” opponents. At the same time, he moves onto the national political stage.

Returned unopposed for North Kilkenny (1902–06), Devlin is appointed secretary of the United Irish League of Great Britain in 1903, and of the parent body in Dublin in 1904. A speaking tour of the United States in 1902–03 convinces him of the organisational potential of Catholic fraternal organisations, and in 1905 he takes over the presidency of the Board of Erin faction of the Ancient Order of Hibernians (AOH), a specifically Catholic body which he proceeds to develop as an organisational arm of the Nationalist Party. Under his tutelage the AOH expands from 10,000 members in 1905 to 60,000 in 1909, despite opposition from some Catholic bishops who distrust it because of its close affiliation to Dillonism, its secrecy, and its habit of staging dances and other entertainments without paying what they regard as due deference to local priests. His AOH also faces opposition from a rival separatist body, the Irish-American Alliance AOH. Though far less numerous, this group is able to draw on the support of separatists within the American AOH and hinder Devlin’s attempts to mobilise the American organisation in his support. The AOH expands further after 1910, and is strengthened by becoming an approved society under the National Insurance Act 1911.

Belfast is where Devlin’s political career begins and where it ends. Organisational skill contributes substantially to his hold on the largely working-class seat of Belfast West, which he wins in 1906 on a platform that seeks to transcend religious boundaries by combining labour issues with the home rule demand. A lifelong bachelor, though short in stature, he is apparently highly attractive to women, and takes a special interest in their problems, no doubt mindful of the influence they might have on the political behaviour of their spouses. He founds a holiday home for working-class women. When the scholar Betty Messenger interviews former Belfast linen workers in the late 1960s and early 1970s, she is startled to discover the extent to which Devlin is remembered as a champion of the workers decades after his death. This image persists among Protestant workers as well as Catholics, and he is generally credited with various ameliorations of workplace conditions even when he had not been responsible for them.

Possessed of great oratorical skills and even greater organisational ability, Devlin effectively becomes the key organiser of the Nationalist Party from the early years of the twentieth century, relieving the party leader, John Redmond, of a great deal of the administrative burden of party affairs, and becoming well known abroad through fund-raising trips, especially in North America. His personal geniality makes him a great favourite at Westminster, and Irish socialists are dismayed at the willingness of British Labour Party MPs to accept him as an authentic Labour representative. Several MPs elected after 1906 can be identified as his protégés, and groups of Hibernian strong-arm men uphold the party leadership in such contests as the 1907 North Leitrim by-election and the 1909 “baton convention” which witnesses the final departure of William O’Brien and his supporters from the UIL. He is the only post-Parnellite MP to be admitted to the tight leadership group around Redmond. In 1913 he is a leading organiser of the National Volunteers.

When William O’Brien embarks on his personal initiative to deal with the Ulster problem through conciliation in the early Edwardian period, he finds a stern critic in Devlin and in turn demonises the “Molly Maguires” as sectarian corruptionists. Personally non-sectarian, Devlin, like other party leaders, endorses the shibboleth that home rule will prove a panacea for Ireland’s problems, including Ulster, and uses his credentials as a labour representative to dismiss popular unionism as a mere product of elite manipulation. In a period when the Vatican‘s Ne Temere decree on religiously mixed marriages is heightening Protestant fears about the “tyranny” of Rome, he seems to be oblivious to how his integration of Hibernianism and nationalism is exacerbating that problem. As the third home rule bill passes through Parliament and the Ulster Volunteer Force (UVF) mobilises, he encourages the Irish party leaders in the view that the Ulster unionist campaign is a gigantic bluff, dismissing contrary opinions even when held by other nationalist MPs. During these years the AOH clashes with the Irish Transport and General Workers’ Union (ITGWU) during the Dublin lock-out, and from late 1913 the AOH spearheads the Redmondite attempt to take over and dominate the Irish Volunteers.

Devlin endorses Redmond’s support for the British war effort and engages in extensive recruiting activity. He seems to be motivated, at least in part, by the belief that after the war nationalist ex-soldiers can be used to overawe the Ulster unionists by the threat of force. According to Stephen Gwynn, Devlin wishes to apply for an officer’s commission but is asked not to do so by Redmond on the grounds that the party needs his organisational skills.

Devlin’s career is decisively shaped by his decision to use his influence to persuade northern nationalists to accept temporary partition, in fulfilment of the flawed agreement arrived at between David Lloyd George, Sir Edward Carson, and Redmond in the aftermath of the 1916 Easter Rising. He later claims he has been decisively influenced by the prospect that under this agreement the excluded area would be governed directly from Westminster, rather than by a local, Orange-dominated parliament. He forces the agreement through a Belfast-based convention despite protests from west Ulster nationalists, but the proposal collapses after it transpires that Lloyd George has made incompatible commitments to nationalists and unionists. Northern nationalism immediately splits between west and south Ulster dissidents and Devlin’s loyalists predominant in Belfast and east Ulster, and the next year sees massive secessions of AOH members outside Ulster to Sinn Féin. Although he retains a core of loyal supporters, he is reduced from a national to a sectional leader. As a member of the Irish convention (1917–18) he sides with Bishop Patrick O’Donnell against Redmond on the issue of seeking a compromise settlement with southern unionists on the basis of home rule without fiscal autonomy. He is offered the leadership of the Nationalist Party on Redmond’s death in 1918, but concedes the honour to his long-standing mentor, John Dillon.

Devlin holds Belfast West until 1918, and easily sweeps aside an attempt by Éamon de Valera to displace him from the Falls division of Belfast at the general election of that year, though the electoral decimation of the Nationalist Party elsewhere leaves him leading a rump of only seven MPs. In the ensuing parliament he is an outspoken critic of government policy towards Ireland and highlights sectarian violence against northern nationalists. Clearly discouraged and with boundary changes militating against retention of the Falls seat, he unsuccessfully contests the Liverpool Exchange constituency as an Independent Labour candidate in 1922. Elected for Antrim and Belfast West to the Parliament of Northern Ireland in 1921, he eventually takes his seat in 1925, holding it until 1929, when he combines representation for Belfast Central with that for Fermanagh and South Tyrone at Westminster.

Only after the boundary commission ends the border nationalists’ hopes of speedy incorporation in the Irish Free State is Devlin able to assert leadership of northern nationalism as a whole on the basis of attendance at the northern parliament. Even then he is considerably handicapped by recriminations over the events of 1916–25. He embarks on his last significant political campaign in 1928, when he seeks to unite minority politics through the agency of the National League of the North (NLN). The initiative, emphasising social reform, is unsuccessful. His own political baggage is a hindrance to the unity of the factions that minority politics had thrown up over the previous ten years, while the minority community itself is politically demoralised by the fate that has overtaken it, and the unionist government shows itself unwilling to make concession to him. The project, moreover, coincides with the onset of the gastric illness, exacerbated by heavy smoking, that takes his life on January 18, 1934. For some time before his death he ceases to attend the Northern Ireland parliament.

Devlin’s political career is one of great promise only partially fulfilled, its ultimate realisation undermined firstly by the fallout from the Easter Rising that destroyed the vehicle of his political ambitions, and secondly by the sequence of events that led to the creation of a constitutional entity so constructed that all nationalist politicians, regardless of talent, were effectively denied a route to power. Only at his death does the unionist regime adequately acknowledge his political stature. His funeral is attended by at least three Northern Ireland cabinet ministers, together with representatives of the government of the Irish Free State. Northern nationalism never again produces a leader of his ability in the Stormont era. His ability to use Westminster to promote the interests of Ulster nationalists is comparable to John Hume‘s use of Europe for the same purpose from the mid 1970s. After his death the nationalist party in Belfast grows increasingly reliant on middle-class leadership and is eventually displaced by nationalist labour splinter groups, some of whose prominent activists, such as Harry Diamond, had begun their careers as election workers for Devlin.

Birth of Brian Faulkner, Sixth & Last Prime Minister of Northern Ireland

Arthur Brian Deane Faulkner, Baron Faulkner of Downpatrick, the sixth and last Prime Minister of Northern Ireland, is born on February 18, 1921, in Helen’s Bay, County Down.

Faulkner is the elder of two sons of James, owner of the Belfast Collar Company, and Nora Faulkner. His younger brother is Colonel Sir Dennis Faulkner. He is educated initially at Elm Park preparatory school, Killylea, County Armagh, but at 14, preferring to stay in Ireland, is sent to the Church of Ireland-affiliated St. Columba’s College at Whitechurch, County Dublin, although he is Presbyterian. His best friend at the school is Michael Yeats, son of W. B. Yeats. He enters Queen’s University Belfast in 1939 to study law, but, with the advent of World War II, he quits his studies to work full-time in the family shirt-making business. He is the only Prime Minister of Northern Ireland to have been educated in the Irish Free State and one of only two to have been educated in Ireland.

Faulkner becomes involved in unionist politics, the first of his family to do so, and is elected to the Parliament of Northern Ireland as the Ulster Unionist Party (UUP) Member of Parliament (MP) for the constituency of East Down in 1949. His vociferous traditional unionist approach to politics ensures him a prominent backbench position. He is, at the time, the youngest ever MP in the Northern Irish Parliament. He is also the first Chairman of the Ulster Young Unionist Council in 1949. In 1956 he is offered and accepts the job of Parliamentary Secretary to the Ministry of Finance, or Government Chief Whip.

In 1959, Faulkner becomes Minister of Home Affairs and his handling of security for most of the Irish Republican Army‘s border campaign of 1956–62 bolsters his reputation in the eyes of the right wing of Ulster unionism.

When Terence O’Neill becomes Prime Minister in 1963 he appoints Faulkner, his chief rival for the job, as Minister of Commerce. He resigns in 1969 over the technicalities of how and when to bring in the local government reforms which the British Labour government is pushing for. This is a factor in the resignation of O’Neill, who resigns as Prime Minister in the aftermath of his failure to achieve a good enough result in the 1969 Northern Ireland general election.

In the ensuing leadership contest, Faulkner loses out again when O’Neill gives his casting vote to his cousin, James Chichester-Clark. In 1970, he becomes the Father of the House. He comes back into government as Minister of Development under Chichester-Clark and in a sharp turn-around, begins the implementation of the political reforms that were the main cause of his resignation from O’Neill’s cabinet. Chichester-Clark himself resigns in 1971 as the political and security situation and the more intensive British interest proves difficult.

Faulkner is elected leader of the Ulster Unionist Party and Prime Minister. In his initial innovative approach to government, he gives a non-unionist, David Bleakley, a former Northern Ireland Labour Party (NILP) MP, a position in his cabinet as Minister for Community Relations. In June 1971, he proposes three new powerful committees at Stormont which would give the opposition salaried chairmanships of two of them.

However, this initiative (radical at the time) is overtaken by events. A shooting by soldiers of two nationalist youths in Derry causes the Social Democratic and Labour Party (SDLP), the main opposition, to boycott the Stormont parliament. The political climate deteriorates further when, in answer to a worsening security situation, Faulkner introduces internment on August 9, 1971. This is a disaster and causes the situation to worsen.

Despite this, Faulkner continues his radical approach to Northern Irish politics and, following Bleakley’s resignation in September 1971 over the internment issue, appointes Dr. G. B. Newe, a prominent lay Catholic, as Minister of State in the Cabinet Office. His administration staggers on through the rest of 1971, insisting that security is the paramount issue.

In January 1972, an incident occurs during a Northern Ireland Civil Rights Association march in Derry, during which paratroopers shoot and killed thirteen unarmed civilians. A fourteenth civilian dies later. What history has come to know as Bloody Sunday is, in essence, the end of Faulkner’s government. In March 1972, he refuses to maintain a government without security powers which the British government under Edward Heath decides to take back. The Stormont parliament is subsequently prorogued, initially for a period of one year, and following the appointment of a Secretary of State for Northern Ireland, William Whitelaw, direct rule is introduced.

In June 1973, elections are held to a new devolved parliament, the Northern Ireland Assembly. The elections split the UUP. Faulkner becomes chief executive in a power-sharing executive with the SDLP and the centre-ground Alliance Party, a political alliance cemented at the Sunningdale Conference that year. The power-sharing Executive lasts only six months and is brought down by a loyalist Ulster Workers’ Council strike in May 1974. In 1974, he loses the leadership of the UUP to anti-Sunningdale elements led by Harry West. He subsequently resigns from the Ulster Unionist Party and forms the Unionist Party of Northern Ireland (UPNI).

The UPNI fares badly in the Northern Ireland Constitutional Convention elections of 1975, winning only five out of the 78 seats contested. Faulkner wins the final seat. In 1976 he announces that he is quitting active politics. He is elevated to the House of Lords in the 1977 New Year Honours list, being created Baron Faulkner of Downpatrick on February 7, 1977.

Faulkner, a keen huntsman, dies on March 3, 1977 following a riding accident while hunting with the County Down Staghounds at the Ballyagherty/Station Road junction near Saintfield, County Down. He is riding at full gallop along a narrow country road when his horse slips, throwing him off and killing him instantly. He is laid to rest at Magherahamlet Presbyterian Church near Spa, County Down where he had been a regular member of the congregation. His twenty-four-day life peerage is thus the shortest-lived until the death of Lord Heywood of Whitehall in 2018 just nine days after ennoblement.

Birth of British Labour Politician Kevin McNamara

Joseph Kevin McNamara KSG, British Labour Party politician who serves as a Member of Parliament (MP) for almost 40 years, is born on September 5, 1934.

McNamara is educated by the Irish Christian Brothers at St. Mary’s College, Crosby and he studies for an LLB at the University of Hull. He is head of department in History at St. Mary’s Grammar School (now called St. Mary’s College) in Kingston upon Hull from 1958–64 and a law lecturer at Hull College of Commerce from 1964–66.

After unsuccessfully contesting Bridlington in 1964, McNamara is elected to the House of Commons as Member of Parliament (MP) for Kingston upon Hull North, in a by-election in January 1966 following the death of sitting Labour MP Henry Solomons. Labour’s hold of a former marginal seat with a significantly increased majority is widely considered to have helped to convince Prime Minister Harold Wilson to call the 1966 election to seek a larger majority.

McNamara retains his seat at the 1966 general election, and at subsequent elections until the constituency is abolished for the February 1974 general election, when he transfers to the new Kingston upon Hull Central constituency. When that constituency is abolished for the 1983 election, he is re-elected for the re-created Kingston upon Hull North constituency.

McNamara campaigns in his last years in parliament on many issues, protesting against the Act of Succession which prohibits a Roman Catholic or the spouse of a Roman Catholic to be the British monarch. He steps down at the 2005 general election, with the local Constituency Labour Party choosing Diana Johnson to stand in his place.

During the 2005 general election campaign McNamara claims some of the policies regarding illegal travelers’ sites of the leader of the Conservative Party, Michael Howard, had a “whiff of the gas chambers” about them. Howard’s grandmother died at Auschwitz.

McNamara is known throughout his parliamentary career as a supporter of Irish nationalism and favours a United Ireland. After entering parliament, he soon becomes interested in reports of discrimination against the Catholic minority in Northern Ireland and supports the Campaign for Democracy in Ulster (CDU). He serves as a frontbench spokesman for the Labour Party, including Shadow Secretary of State for Northern Ireland under Neil Kinnock, 1987–94, an appointment that is widely criticised by Unionists.

After Tony Blair becomes Labour leader, he replaces McNamara as Northern Ireland spokesman with Mo Mowlam. In 1997, he helps persuade the newly elected Labour government to donate £5,000 (thereby matching the contribution of the Irish government) for the erection of a memorial in Liverpool to the victims of the Great Irish Famine. He also supports Republicanism in the United Kingdom and joins the All-Party Parliamentary Republic Group.

McNamara is a Roman Catholic and a Knight of the Pontifical Order of Saint Gregory the Great. He is married to Nora McNamara, and is the father of four sons and a daughter.

In 2006, McNamara receives the honorary degree of Doctor of Laws from the University of Hull in recognition of his long service in politics. He graduates with a Ph.D from the University of Liverpool in 2007 having completed a thesis on the MacBride Principles at the Institute of Irish Studies, where he gives the 2008 John Kennedy Lecture in Irish Studies, Perhaps It Will All Go Away – an Examination of the British Response to the Civil Rights Movement in Northern Ireland.

In 2017, McNamara is diagnosed with pancreatic cancer while on holiday in Spain. He dies on August 6, 2017 at Formby, England, at the age of 82.

Introduction of the Third Home Rule Bill

Prime Minister of the United Kingdom Herbert Henry Asquith, a member of the Liberal Party, introduces the Third Home Rule Bill on April 11, 1912, which would provide self-government for Ireland, an apparent triumph for Nationalist leader John Redmond.

As a minority party after 1910 elections, the Liberal Party depends on the Irish vote, controlled by John Redmond. To gain Irish support for the budget and the parliament bill, Asquith promises Redmond that Irish Home Rule will be the highest priority. It proves much more complex and time-consuming than expected. Support for self-government for Ireland had been a tenet of the Liberal Party since 1886, but Asquith has not been as enthusiastic, stating in 1903 (while in opposition) that the party should never take office if that government would be dependent for survival on the support of the Irish Nationalist Party. After 1910, though, Irish Nationalist votes are essential to stay in power. Retaining Ireland in the Union is the declared intent of all parties, and the Nationalists, as part of the majority that keep Asquith in office, are entitled to seek enactment of their plans for Home Rule, and to expect Liberal and Labour support. The Conservatives, with die-hard support from the Protestant Orange Order of Ulster, are strongly opposed to Home Rule. The desire to retain a veto for the House of Lords on such bills has been an unbridgeable gap between the parties in the constitutional talks prior to the December 1910 United Kingdom general election.

The cabinet committee (excluding Asquith) that in 1911 plans the Third Home Rule Bill opposes any special status for Protestant Ulster within majority-Catholic Ireland. In 1913, Asquith writes to Winston Churchill, stating that the Prime Minister has always believed and stated that the price of Home Rule should be a special status for Ulster. In spite of this, the bill as introduced in April 1912 contains no such provision, and is meant to apply to all Ireland. Neither partition nor a special status for Ulster is likely to satisfy either side. The self-government offered by the bill is very limited, but Irish Nationalists, expecting Home Rule to come by gradual parliamentary steps, favours it. The Conservatives and Irish Unionists oppose it. Unionists begin preparing to get their way by force if necessary, prompting nationalist emulation. Though very much a minority, Irish Unionists are generally better financed and more organised.

Since the Parliament Act the Unionists can no longer block Home Rule in the House of Lords, but only delay Royal Assent by two years. Asquith decides to postpone any concessions to the Unionists until the bill’s third passage through the House of Commons, when he believes the Unionists will be desperate for a compromise. Biographer Roy Jenkins concludes that had Asquith tried for an earlier agreement, he would have had no luck, as many of his opponents wanted a fight and the opportunity to smash his government. Sir Edward Carson, MP for the University of Dublin and leader of the Irish Unionists in Parliament, threatens a revolt if Home Rule is enacted. The new Conservative leader, Bonar Law, campaigns in Parliament and in northern Ireland, warning Ulstermen against “Rome Rule,” that is, domination by the island’s Catholic majority. Many who oppose Home Rule feel that the Liberals have violated the Constitution by pushing through major constitutional change without a clear electoral mandate, with the House of Lords, formerly the “watchdog of the constitution,” not reformed as had been promised in the preamble of the 1911 Act and thus justified actions that in other circumstances might be treason.

The passions generated by the Irish question contrast with Asquith’s cool detachment, and he writes about the prospective partition of the county of Tyrone, which has a mixed population, deeming it “an impasse, with unspeakable consequences, upon a matter which to English eyes seems inconceivably small, and to Irish eyes immeasurably big.” As the House of Commons debate the Home Rule bill in late 1912 and early 1913, unionists in the north of Ireland mobilise, with talk of Carson declaring a Provisional Government and Ulster Volunteer Forces (UVF) built around the Orange Lodges, but in the cabinet, only Churchill views this with alarm.

These forces, insisting on their loyalty to the British Crown but increasingly well-armed with smuggled German weapons, prepare to do battle with the British Army, but Unionist leaders are confident that the army will not aid in forcing Home Rule on Ulster. As the Home Rule bill awaits its third passage through the House of Commons, the so-called Curragh incident occurs in March 1914. With deployment of troops into Ulster imminent and threatening language by Churchill and the Secretary of State for War, John Seely, around sixty army officers, led by Brigadier General Hubert Gough, announce that they would rather be dismissed from the service than obey. With unrest spreading to army officers in England, the Cabinet acts to placate the officers with a statement written by Asquith reiterating the duty of officers to obey lawful orders but claiming that the incident had been a misunderstanding. Seely then adds an unauthorised assurance, countersigned by Sir John French, the professional head of the army, that the government has no intention of using force against Ulster. Asquith repudiates the addition, and requires Seely and French to resign, taking on the War Office himself, retaining the additional responsibility until hostilities against Germany begin.

Within a month of the start of Asquith’s tenure at the War Office, the UVF lands a large cargo of guns and ammunition at Larne, but the Cabinet does not deem it prudent to arrest their leaders. On May 12, Asquith announces that he will secure Home Rule’s third passage through the House of Commons (accomplished on May 25), but that there will be an amending bill with it, making special provision for Ulster. But the House of Lords make changes to the amending bill unacceptable to Asquith, and with no way to invoke the Parliament Act on the amending bill, Asquith agrees to meet other leaders at an all-party conference on July 21 at Buckingham Palace, chaired by King George V. When no solution can be found, Asquith and his cabinet plans further concessions to the Unionists, but this does not occur as the crisis in Europe erupts into war.

In September 1914, after the outbreak of the conflict, Asquith announces that the Home Rule bill will go on the statute book as the Government of Ireland Act 1914 but will not go into force until after the war. He adds that in the interim a bill granting special status to Ulster will be considered. This solution satisfies neither side.

Birth of Sir James Comyn, Irish-born English High Court Judge

Sir James Peter Comyn, Irish-born barrister and English High Court judge, is born at Beaufield House, Stillorgan, County Dublin on March 8, 1921. Considered by many to be “the finest all-round advocate at the English bar”, he is appointed to the High Court of Justice in 1978, serving on the bench until his retirement in 1985.

Comyn is the son of Nationalist barrister James Comyn KC and of Mary Comyn. Through his father he is the nephew of the barrister Michael Comyn KC. Both his father and uncle had been political and legal advisers to Éamon de Valera, who at one point uses Beaufield House as a safe house. However, the Comyn brothers have a falling out with de Valera shortly before he comes to power in 1932, and Michael Comyn is passed over as Attorney General of the Irish Free State. As a result, James Comyn, who is then attending Belvedere College in Dublin, is sent by his father to attend The Oratory School in England. He spends six months as a trainee at The Irish Times under the editor R. M. “Bertie” Smyllie, but abandons journalism after a joke he added to an obituary is printed in the paper, leading to his demotion to the racing department.

Comyn then matriculates at New College, Oxford, where he reads law, graduating with Second Class Honours. In 1940, he defeats Roy Jenkins for the presidency of the Oxford Union, winning by four votes. After suffering the first of several breakdowns through his life, he briefly works for the BBC‘s Empire Service during World War II.

Comyn is called to the English bar by the Inner Temple in 1942, the Irish bar in 1947, and the Hong Kong bar in 1969. In 1944, he begins his pupillage with Edward Holroyd Pearce KC, later a law lord, and joins his chambers at Fountain Court. He practises in London and on the Western circuit, supplementing his earnings by teaching banking, a subject of which he knows nothing. On one occasion, he rises in Lambeth County court to cross-examine a female defendant in an eviction case. Just as he begins by saying “Madam,” the defendant opens her bag, takes out a dead cat, and throws it at him. The judge’s reaction is to tell the defendant, “Madam, if you do that again, I’ll commit you.” Comyn wins the case.

Comyn takes silk in 1961, and acquires a large practice as a senior, appearing in many high-profile cases. In 1964, he wins damages for libel for the former safe-breaker Alfred George Hinds against a Scotland Yard inspector by convincing the jury that Hinds is in fact innocent. In 1970, he successfully defends the Labour MP Will Owen, who is accused of providing information to the Czechoslovak intelligence services. In 1975, he defeats the government’s attempt to obtain an injunction against the publication of the diaries of former minister Richard Crossman.

Comyn is Recorder of Andover between 1964 and 1971 (honorary life recorder from 1972), commissioner of assize for the Western Circuit in 1971, and a Recorder of the Crown Court between 1972 and 1977. He is elected a bencher of the Inner Temple in 1968, and serves as chairman of the Bar council from 1973 to 1974.

Having refused a previous invitation by Quintin Hogg, Baron Hailsham of St. Marylebone to join the bench, Comyn is again nominated by Elwyn Jones, Baron Elwyn-Jones, in 1977, and is appointed a High Court judge in 1978, receiving the customary knighthood upon his appointment. Initially assigned to the Family Division, he does not take to the work and is reassigned to the Queen’s Bench Division in 1979. He has a reputation for leniency in sentencing, first acquired as Recorder of Andover. In 1980–81, he presides over an unsuccessful libel action by a member of the Unification Church, colloquially known as the Moonies, against the Daily Mail, the longest libel trial in England up to that time. His Irish background makes him the target of Irish Republican Army (IRA) action, and in 1981 the Provisional IRA burns his house in Tara.

Recurring bouts of depression lead to Comyn’s early retirement, on grounds of ill health, in 1985. In retirement, he divides his time between England and Ireland, whose citizenship he has retained. He writes a number of books, including memoirs, light verse, and books on famous trials. He also breeds Friesian cattle. He dies in Navan, County Meath on January 5, 1997 at age 75.

Dissolution of the Northern Ireland Constitutional Convention

In the House of Commons of the United Kingdom on March 5, 1976, Secretary of State for Northern Ireland Merlyn Rees announces the dissolution of the short lived Northern Ireland Constitutional Convention (NICC).

The Northern Ireland Constitutional Convention is an elected body set up in 1975 by the United Kingdom Labour government of Harold Wilson as an attempt to deal with constitutional issues surrounding the status of Northern Ireland.

The idea for a constitutional convention is first mooted by the Northern Ireland Office in its white paper The Northern Ireland Constitution, published on July 4, 1974. The paper lays out plans for elections to a body which would seek agreement on a political settlement for Northern Ireland. The proposals become law with the enactment of the Northern Ireland Act 1974 later that month. With Lord Chief Justice of Northern Ireland Robert Lowry appointed to chair the new body, elections are announced for May 1, 1975.

The elections are held for the 78-member body using the single transferable vote system of proportional representation in each of Northern Ireland’s twelve Westminster constituencies. Initially the body is intended to be purely consultative, although it is hoped that executive and legislative functions can be devolved to the NICC once a cross-community agreement has been reached. Unionists opposed to the NICC once again band together under the umbrella of the United Ulster Unionist Council (UUUC) and this coalition proves the most successful, taking 46 seats.

A number of leading Northern Ireland politicians are elected to the NICC, increasing hope that the body might achieve some of its aims. Also elected are some younger figures who go on to become leading figures in the future of Northern Ireland politics.

The elections leave the body fundamentally weakened from its inception as an overall majority has been obtained by those Unionists who oppose power sharing as a concept. As a result, the Northern Ireland Constitutional Convention Report published on November 20, 1975 recommends only a return to majority rule as had previously existed under the old Parliament of Northern Ireland government. As such a solution is completely unacceptable to the nationalist parties, the NICC is placed on hiatus.

Hoping to gain something from the exercise, Secretary of State for Northern Ireland Merlyn Rees announces that the NICC would be reconvened on February 3, 1976. However, a series of meetings held between the UUUC and the Social Democratic and Labour Party (SDLP) fail to reach any agreement about SDLP participation in government, and so the reconvened NICC once again fails to achieve a solution with cross-community support. As a result, Rees announces the dissolution of the body on March 5, 1976 and Northern Ireland remains under direct rule.

On the face of it, the NICC is a total failure as it does not achieve its aims of agreement between the two sides or of introducing ‘rolling devolution’ (gradual introduction of devolution as and when the parties involved see fit to accept it). Nevertheless, coming as it does not long after the Conservative-sponsored Sunningdale Agreement, the NICC indicates that no British government will be prepared to re-introduce majority rule in Northern Ireland. During the debates William Craig accepts the possibility of power-sharing with the SDLP, a move that splits the UUUC and precipitates the eventual collapse of the Vanguard Unionist Progressive Party (VUPP).

The idea of electing a consultative body to thrash out a deal for devolution is also retained and in 1996 it is revived when the Northern Ireland Forum is elected on largely the same lines and with the same overall purpose. The Forum forms part of a process that leads to the Good Friday Agreement and the Northern Ireland Assembly.

Birth of Ewart Milne, Irish Poet

ewart-milneEwart Milne, Irish poet, is born in Dublin on May 25, 1903, He describes himself on various book jackets as “a sailor before the mast, ambulance driver and courier during the Spanish Civil War, a land worker and estate manager in England during and after World War II” and also “an enthusiast for lost causes – national, political, social and merely human.”

Milne is born of English and Welsh-Irish parents and is educated at Christchurch Cathedral Grammar School. In 1920 he signs on as a seaman and works on boats, off and on, until 1935. During the 1930s he begins writing and has his first poems published in 1935.

The background to the Spanish Civil War contributes to Milne’s political awakening and he comes to England to work as a voluntary administrator for the Spanish Medical Aid Committee in London, for whom he often acts as a medical courier. He also was once unwillingly involved in an arms deal while visiting Spain on their behalf.

After Spanish Medical Aid Committee is wound up, Milne returns to Ireland but remains politically active in support of the campaign for the release of Frank Ryan, the leader of the Connolly Column of Irish volunteers on the Republican side, who had been captured and imprisoned in Spain. At one point he takes part in a delegation to Westminster seeking Labour Party support for this. In August 1938 he is reported in The Worker’s Republic as being one of the twelve member committee of the James Connolly Irish club in London.

During his time in England and Spain, Milne gets to know the left-leaning poets who support the Republican cause, including W. H. Auden, Stephen Spender and Cecil Day-Lewis. In 1938 his first collection of poems, Forty North Fifty West, is published in Dublin, followed by two others in 1940 and 1941. Having taken a pro-British line in neutral Ireland, he is informed by Karl Petersen, the German press attaché in Dublin, that he is on the Nazi death list. This convinces him to help in the British war effort and he returns to England with the help of John Betjeman, then working at the British embassy in Ireland.

Between 1942–1962 Milne is resident in England and an active presence on the English literary scene. In particular he becomes associated with the poets grouped around the magazine Nine, edited by Peter Russell and Ian Fletcher. He and his wife Thelma also back the young Irish poet Patrick Galvin when he launches his own magazine, Chanticleer. This generous encouragement of younger writers is later extended to several others, including John F. Deane, Gerald Dawe and Maurice Scully.

Milne regards his return to Dublin in 1962 as a disaster, as his four-year stay is overshadowed by quarrels with the establishment, the discovery of betrayal by a friend and the death of his wife from lung cancer. The misery of those events is recorded in Time Stopped (1967). The artistic frustration of the time also results in the poems included in Cantata Under Orion (1976). Returning to England in 1966, he settles in Bedford. Politically he remains involved and speaks alongside Auberon Waugh at the rally on behalf of Biafra in 1968, but his views move further to the right in later years. He writes to The Irish Times on April 13, 1976, saying that he has been “taken in by Stalin and that Leninism is Satanism.” He also sides with the Loyalist position in the Ulster conflict. He dies in Bedford of a heart attack on January 14, 1987.

Milne is twice married, first to Kathleen Ida Bradner in 1927, by whom he has two sons; then in 1948 to Thelma Dobson, by whom he has two more sons.
